    Default Hurt on the job but no one mentioned workers comp

    I was injured on my job and everyone at work knows this. While i was out for a week and now have to use a walker and cant do much at work. I now am getting the ER bills and no one mentions workers comp. I even wasnt paid during the time off. I had a note from my doctor. They acknowledge I was hurt even brought me lunch one day but no mention of workers comp. What do I do ????

    go to your boss and file a claim now!!!! Today!!! This is against the law for them not to file! Call the labor board in your state they will tell you.

    You are assuming everyone knows it. Does your supervisor/shift manager/HR director/ or home office know about the accident? It is your responibility to report the claim to the appropriate people. Do it now without delay. Request they file the notice of injury and give you a copy. Tell them you want the name of the carrier to start the benefit ball rolling.

    I am sorry, I just thought since they brought him lunch while injured, there seemed a huge probability that his work was aware of the injury and how it occured. "On the job". I am not trying to open a can of worms here, but he does need to take care of this as soon as possible. Laws do protect him and he does need to be aware of where and how he can get this information.

    First thing is did you fill out an "accident report"? And then you need to fill out a 30C form with the Workers Compensation office in the Town/City you work in. You can get one of these off line or call and they will send it to you. You then fill out the form and send it via certified return receipt to the Workers compensation office as well as your employer.

    good Luck... Your going to need it dealing with Workers comp.

    UPDATE:::::::

    I am the one that posted this and my injury has not gotten better and finally was referred to specialist who has diagnosed my ankle sprain to also be RSD ... anyone have any advice? My employer says they will file the paper work now but hasnt as of today. And yes they all know that it happened at work. Any advice?

    You can always call the Work Comp Board for your state and ask them to send you the "report of injury" form. Send it back to them so at least you meet any filing deadlines. Ask your empolyer one more time to start the ball rolling. And you need to be firm in your demands. Then start looking in the yellow pages for an attorney. Hopefully you won't need one but it doesn't hurt to be prepared. Also, the adjuster for the insurance company and the nurse case manager for the insurance company aren't their to help you. Nor will they try to protect your interest. Their only job is to dispose of the claim as cheaply as possible. That's all the are interested in. They could care less about you.

    UPDATE AGAIN:

    I now know why they didnt file it with workers comp... they dont have any... they never got it and it isnt that they didnt know to ... they just didnt. The owner just called me to the conference room and told me he will just pay the medical bills ... but how to I make sure ... what about me and my life and my wages... I have RSD cause of what happened....

    Help!!!!!!!!!!
