    Default Hernia From Work

    Hello, I am a 24 year old male who suffered a hernia in april of 2006. I immediately recieved treatment from workers comp, along with temp benefits. I needed to have surgery to repair the hernia. I cooperated and went for surgery. The surgery fixed my hernia, but now I have severe pain and numbness in the groin area, that wasn't there before the surgery. The insurance company sent me for several surgical consultations along with a few specialists. I also have written recomendations from my own doctors all who witch agree that i need another surgery to fix this new problem witch is an entrapped nerve. The insurance company just sat around for months not doing anything, but they were still paying me, and paying for prescriptions from my personal doctors. All of a sudden in october they stopped my checks for no reason, and refuse to send me to a doctor. I had an attorney the whole time, who did nothing for me but file a petition for med and temp benefits. I he cancelled numerous hearings for unknown reasons. Now about a month ago he called me and said i quit. I have a court hearing for my petition for med and temp benefits on Feb 02 2007. I have no attorney, so I am going pro se. I have a total of 7 reports stating I need surgery to fix this problem. I cant seem to find another lawyer, because I guess they have to split the fees of the case. I have no option but to go pro se. I have lost everything due to this case, so I need to do something, I am in serious pain everyday. I will go to court pro se because I believe i have a solid case. Just want to know if anyone has any advise, or can recomend an attorney. Thanks

    I fired 2 comp attorneys and dared them to ask for more $. I kept all my records and found a new one. luckily a girl from high school I knew. but she didnt do anything but submit my records and state the fact. I paid her 5 grand for that. should have done it myself

    if your lawyer called you and said he quit yuou will owe him nothing also tell him you are going to call the bar on him also and report him then do it . then go and get another lawyer if he quit then he does not get anything then call another lawyer and file a lawsuite on the one that quit you have many outs right now use them

    I recently found this online post from my son. Sadly, my precious son, Brandon Beshada, passed away from complications surrounding his hernia injury on April 1, 2007. My son had just turned 25 years old and had his whole life ahead of him. I believe with all my heart and soul that had his workers comp insurance co approved the corrective surgery, the surgery that 8 surgeons recommended, that my son would be alive today.

    Sandy, my heartfelt condolences for the loss of your precious son. I am the mother of two boys that are my life. If anything were to happen to either one of them my life would be forever altered in ways I dare not think of.

    Have you had any contact with the WC IC concerning benefits due your son's next of kin. His death is such a shame when all it would have taken is less delay and denial for his treatment. Have you spoken to an attorney concerning the denials for his treatment that contributed to his death? Was your son married? Did he have any children? Again dear my heart goes out to you and your family. Please let us know if there is anything we can do to help you.

    Thank you for your heartfelt condolences on the loss of my precious son Brandon. My son was not married and he did not have any children. I do have attorney's working on the case so I can't go into much detail. I promised my son after he passed that I would continue to fight his fight for him. Unfortunately nothing will ever bring my son back but hopefully we can prevent this horrific treatment from causing another family this pain. Please continue to keep my son in your thoughts and prayers. I am Brandon's voice now and I will be screaming or justice for him.

    It would be a huge mistake to represent yourself in this pending matter!!!!!!!! You may feel you have a solid case but do you understand exactly what the NJWC law is, because only if the NJWC law will permit your action will you succeed

    The written recommendations from your personal DRs are MEANINGLESS unless they are the treating DRS who are recognized by NJWC Court as experts in their field

    I believe the insurance company was allowing conservative treatment including rest to see if the pain would subside. Your TTD checks and corrective medical care ends when the treating DR rates you at MMI. I believe this is why you do not now get medical care or TTD because under NJWC law you are no longer eligible for such after MMI from treating DR.

    I can suggest an expert in disability/ WC law that may even tell you same, its just hard to say with the little info given here.

    I cant keep tract of which boards permits posting of legal expert and which do not however if you write me through the message private board here or directly to my email I will gladly suggest the best WC lawyer in NJ. Which any WC JUDGE will agree!!!!!!!

    Sandy, What a brave and courageous woman you are. A mother to be admired for sure. To be concerned for others when you have suffered such a loss speaks volumes for your character. Brandon must have been very proud to have had a mama like you. I hope that you are very successful in your effort to help keep others from facing the same fate as your Brandon and now the family that he leaves behind that will miss him until their own passing. Good Luck to you dear woman and please post back from time to time and let us know how you are progressing. You will be thought of prayed for daily by myself and many others that visit here.

    My son's Dr's, more than half being worker's comp Dr's, refused to release my son to go back to work - Worker's Comp had NO reason for denying my son weekly compensation or more importantly his medical treatment, as recommended by their own Dr's. Sadly my son passed on April 1, 2007. I have an attorney working on the case and in addition to seeking the weekly compensation and the payment of all medical bills he is also seeking funeral expense reimbursement. Again my son was NEVER rated by any workman's comp Dr. to return to work in any capacity. Please, please, please do not defend this heartless insurance company - their denial of medical treatment for my son caused his death !!
