    Unhappy Waiting For A Check

    its been 1 month now and i have not gotten a check from workerscomp 2 missing checks i called my lawyer 2 weeks ago and all he said to me was he was waitting for a return phone call from workerscomp ? well that was 2 weeks ago , so after that i sent him an e mail asking him about what he is doing about my checks that i have not recived , he wrote me back saying as soon as i find anything out i will let you know And that was it ! now 2 weeks after that again im missing another check and again i cannot get my lawyer to pick up the phone and talk to me or write me back im besides myself my rent is due my phone and a car [payment . workerscomp has not sent me any letter in the mail , ? please i need some advice thank you this is in pa

    Depending on your state regulations you could pursue penalties and interest. Of equal concern is your attorney's lack of concern with your problem. I would suggest you schedule a meeting with him to discuss this. If you are still not satisfied with his service then look for a new attorney.

    you need an attorney who is willing to drag them into comp court.
    The problems will only get worse as you get closer to impairment rating time.

    you should call the insurance company responsible for your payments and ask who is your ajuster. once you do that,ask them to tranfer you and ask her why you haven't received your check, you have to be on top don't wait for lawyers, they don't know how bad we need those checks thats how i usualy do i call them myself.

    Stirfry, I'm from Pa. and have been at this at this for a while. Your Attorney NEEDS to file a Penalty Petition for lack of Payment, and You need to call Your Attorney A.S.A.P. and have Them give You Permission to call the Adjuster. Tell the Lawyers Assistant enough is enough, you NEED Money and You are going to have to handle it Yourself, and if that's the Case You probably won't be needing them any Longer, You will be back in touch with them with Your decision. Put some real strong HEAT under the Attorney's A**, quite frankly, if my Attorney didn't call me back in Two-Weeks, I would have another. I made it very clear to mine that when I call it's not to talk about the Weather, I need an Answer, and He's been Great About it. I once asked for my entire Case File, and He ask if He was being replaced, and I told Him No, I wanted them for my Records and I received them, and Have them in case I ever need another Attorney. They work For YOU, remind them of that and tell them you want answers NOW!!!

    If your attorney is not helping you, I would definitely recommend that you get another. Do it quickly; however, as you will/may have to pay the current attorney for services rendered. It seems that many W/C-P/I attorneys just want to get clients on their books and then not provide adequate service. I guess they simply want to wait W/C out and get their cut of the settlement without really doing much.

    When I was injured, my claims adjuster told me that I would not be compensated for the first three weeks I was out of work after the injury. After I got an attorney, I received a benefits check for those three weeks plus a penalty. If W/C is shafting you even though you have an attorney, chances are they know your representation is not very good. Subsequently, they may feel confident in giving you the run-around.

    This is very true. When I went to have my PPD rating done, the doctor did not even put the rating on the FCE documents. My orthopedic specialist said that the test was not well done and did not give him or W/C any information he had not already provided. He called W/C several times over about two months asking for the PPD rating or for a retest with another doctor. After I called the main office of the person who did the FCE and informed them that I was requesting a PPD rating to present to my attorney, I got the new paper work with the PPD rating included in about 3 days. Since the rating is high 37/15 %, W/C is now questioning the results of a test given by the doctor THEY chose.

    The W/C program in Ga needs to be overhauled, and they can start by getting rid of some of the unprofessional people who work there. I believe all injured workers should contact their congressmen and state representatives and demand change. We pay into this program as workers and we deserve better service.
