New York State Disability Retirement

Unbelievable got workers compensation, approved for SSDI first time around, then NYS denied medical retirement, What gives? As taxpayers it is sad that we have multiple agencies, each with their own set of standards for determining disability. I really got irrate to think that the decision made for SSDI was done by the Dvision of Determination Services, ( a New York State agency) then the retirement system wasted additional funding to get an opinion from an IME. So the break down is that SSDI says there is a disability, workers compensation says there is a disability, and even the veterans administration says there is a disability, but the New York State retirement system says there is not. Meanwhile 3 years after the initial accident still awaiting 3 surgeries, makes me happy that I worked for 40 years. To make it worse I know people in jail , on welfare and on SSDI who have had two or three surgeries, while I wait. What a great state.

This is another State Government System that needs to be reformed. I will tell you my horror story dealing with this system. I worked for a local municipality and have subtained many back injuries over the past thrity years of work. My doctors told my that it is time to retire or risk more injuries to my back. So I filed for my SSD and my NYSDR, after 22 month of hell dealing with the NYSDR I was denied twice. My SSD was approved with no problems and my appeal hearing was cancled due to my injuries. So now I have a marked degree of disability from the New York Workers' Comp. Board. The Federal Government (SSD) now puts me at totally disabled but the NYSDR says there is nothing wrong with you go back to work or the town will fire you. I have talked to many doctors and attorneys over the past six months that deal with the disability system and they tell me the same thing the laws they have made protect themselves not the injured worker. So after looking more and more into this system I have found out the state does not reconize the NYSWCB or SSD. They have set up there own set of laws that protect
them from giving any kind of benifits to the injured worker that gets hurt on the job. So I took the political route for some help, that was a mistake!
I encourage that all state, county, and municipal employees that are in this system to contact your area senator and assemblyman for changes to the two laws that protect the state from your right to disability benifits. The two laws are the NYS Social Security law Section 63 and Section 73 they were made to protect the state! If you need more information on my horror

I have submitted for the appeal, 19 May 08, still haven't heard from them. I realize the odds are against me as I have read the cases on the internet. My injury also is the back. I don't even have a copy of their doctors report, which I have asked for. It is really hard to find a lawyer, especially after the initial denial. What happened with the political route? I am vested and qualified for a service retirement in September of 2009, bet they strecth it out til then. I am amazed that they can sleep at night, I sure can't

Again SSD federal is differant from than SS Laws that are set up in NYS.This state could care less if you were injured on the job and received ssd from the feds. This is what the fight is all about to change the social security laws that protect the state and not the injured worker. People that email me are getting confused about the two. I just went to a pain mangement group and a few people that are really screwed up have received the ssd for the same injuries the state continues to deny them and these people are paying into the
system.

On the NYSRS workers that have been rejected their disability and have been awarded SSD (federal) for the same work related injuries you can contact Senator Clintons office on this matter. It will be her NYC office ask for state affaires or labor affaires. They will get back to you in a day this office is excellant to deal with. They are aware of the problems that injured workers are having with the state disability system. You will fax all your paper work to them do not mail any paper work and they will review your case. They have filed a complaint with my case with the state comptrollers office. Also you can contact her office on Social security issues. The politicians around here just keep passing the issue(NYSDRS) back and forth to each other so don't waste to much time writing letters to them.

The appeal system is just as bad as the regular system my attorney told me don't waste your time or money. I traveled down that road.
