    Question Malingering and Magnification of Symptoms

    My workers compensation claim was made in the State of: NJ
    I keep hearing people talk about IME doctors saying Malingering and Magnification of Symptoms. What is this?

    I think its just like it sounds.....exagerating your injury....saying its moderate when its minor.....or major when its moderate.


    Correct me if Im wrong its just a guess at it....thats how I always took it anyway.

    Ok Slave are you in WV or NJ or are you someone on here trying to get at some injured worker...

    Trust me I wish this hell hole of being a injuried worker was not my life! I'm sure the grass is a hell of alot greener on the other side.. So please don't make me out to be something I'm not. I have enough problems as I'm sure u all do to being trapped in a system that makes u almost loose everything. Sorry about the confusion. I guess u don't want to answer my question since u think I'm "trying to get some injuried worker"

    I was not trying to defame you, the using of 2 differant states is suspicious and I think anyone would agree with me on that. I cant answer on the Malingering because I dont know anything about it. I read the post as I do many so I could learn something. When I said trying to get an injured worker, I was stating that there is people on here that will try to trick you into giving up info and there is CA's that will use what we say on this forum agianst us in some way. Think of your post and then consider the possability of someone trying to get some of your info. and you will understand why i acted the way I did. Im sorry that you are trapped in the system, ive been in it since May of 2006, so i know how it feels. again im sorry if I was wrong.

    Malingering is a medical and psychological term that refers to an individual fabricating or exaggerating the symptoms of mental or physical disorders for a variety of motives, including getting financial compensation (often tied to fraud), avoiding work, obtaining drugs, getting lighter criminal sentences, trying to get out of going to school, or simply to attract attention or sympathy. Because malingerers are usually seeking some sort of primary or secondary gain, this disorder remains separate from somatization disorders and factitious disorders in which the gain is not obvious. Legally, malingering is often referred to as fabricated mental illness or feigned mental illness

    Yeah! And if you happen to be articulate, with a bigger vocabulary than the IME doc WC sent you to, you might be judged as exaggerating/magnifying your symptoms merely due to your verbal ability to describe them in detail! LOL... I learned to dumb down my responses -- although when you spend so much time in pain you get to really know pain in exquisite and elegant terms! (The "real" doctors who care about me are interested in the extra details about my symptoms and want to understand and think how to treat.)

    The IME docs are looking to answer VERY LOADED question lists from WC to send back as a result of your visit. You have to go when you are notified, and as many times as they send you. In my state I could have one IME of my choice paid for by WC. After using that, for self-protection, I always checked the IME doc for license problems/complaints, and asked around for some informal "reputation" data, and, used personal health insurance to duplicate the IME at personal cost. Similarly, I noted if the IME doc's specialty was an "inferior" one to my injury review: In my case a neurosurgeon's opinion is rated higher than an IME orthopedist's -- and I made sure this was broadcast loud and clear. Once I was even sent to a real hotshot specialist -- and the IME intent to undermine my case actually backfired! The same occurred with the psych they sent me to hoping that would give them hope I was a malingerer -- ended up getting a definitive negative report on that. Each IME seems to be another attempt to throw your "compensation" away. Like I said in another post, something that "works" for their cause one time ends up becoming standard operating procedure. They probably have inter-office communications rating what's the latest that's winning for them. There sure seem to be waves or "fads" on what they're up to. When one of these "IME guerrilla attacks" on my case fails I like to think, well, maybe they won't try it on everyone else.
