    Default Laws on How Long Doctors Have to Keep Medical Records

    Is there a law on how long doctors have to keep medical records in the state of NJ? W/C want me to sign and release records from 1995. I don't have any medical records from that time period to provide them. I can't seem to find a law with this exact information. I've asked my lawyer but was given no answer!

    Just give the medical records you can get... that means by signing a release of information for the IC, provide the names of the doctors you have seen for whatever reason. (that you can remember)

    They are seeking a pre exsisting condition/injury that could be a cause to contribute to any permenant disability. That doens't mean they are trying to deny your claim... but the ER/IC is only liable for any disability/impairment due to THIS injury.

    It's called 'apportionment to cause'...and a doctor will make the educated 'guess', on the % to be apportioned..if any.
