    Default End of Claim - How Long Does it Take to Settle

    Generally, how long does it take to settle a claim? Months, Years, etc?

    it really depends on the issues.
    serious injuries can take years of treatment and settlement is not likely until there is some medical resolution especially if there are repeated surgeries and failures. In some cases it can take a while before options or the parties become exhausted.

    Work Comp has already hinted around about settling the claim. They attempted to settle a year ago, but I ended up having another surgery.
    (To date I have had a Medial Menisectomy to the R knee in 2007 and an ACL replacement to the R knee in 2008)

    You question doens't have a 'general'; answer.
    Any time the parties can come to an agreement... the claim can settle.

    You are best to have a impairment/disability rating before negotiating a settlement...how do you know the value of the indemnity you may be due.

    Indemnity or the predetermined number of weeks payments you are due is what the dollar value is based on.
    No money for pain, suffering, lost wage, punitive...not like personal injury.

    Once there is agreement, the documents are drawn, both parties sign, a judge reviews for adequacy and the claim resolves. 60...90...180 days. Depends.

    Trust me when we say " You should get an attorney" because they are jumping on the chance to settle with you without any legal council and TRUST ME they will not give a FAIR amount without an attorney. You have to pay them 20% but 9 out 10 times they get double even triple what the insurance company would offer. You might even have the right to leave medical open plus the settlement. If in 2 years you have major problems arise and you need another surgery because you can't work with your injury, they will have to pay for it.
