    Default Arrival of Benefits

    My wife was injured a while back, and just received an impairment rating (after surgery, physical therapy, and many other things). I know ICC has a mandate on the if you are so much impaired, you get this much for this many weeks. How long should we expect to wait before getting this first check? Also, how do insurance companies figure what they will pay for the "settlement"?

    the benefits can be disputed by either party.
    do you know if there is an agreement on the impairment rating?
    the impairment rating and "settlement" have to be approved by the comp commission.
    a settlement will be the value of the impairment, medcial and any other unpaid benefits.

    You are correct, the IIC/legislature has predetermined the number of weeks indemnity you are due, based on the rating.

    It's not really that simple. Unlike a personal injury case, there is no money for pain and suffering, lost wages, or punitive damages in WC.

    Benefits are wage loss while treating/recovery. PD/impairment indemnity based on the % of loss. The 'loss' being your reduced capacity to compete in the open labor market.
