    Default Who Pays Me, Workmens Comp or My Emloyee for Messing Up

    My workers compensation claim was made in the State of: Calif

    I am 20 yrs old and was put on workmens comp. What i need to know, is i went back to work monday all day, took off to take my son to doctor on tuesday and worked all day after working the full day, i was told i need a doctors release.......so how does that work, with workmens comp? I went back to the doctor to be released and they wont let me go back till this wed.

    Does my work now have to pay me for working those 2 days? will it mess up my workmens comp? do i need to do anything?

    yes your employer should pay for time worked. It should not "mess up" your work comp benefits --- comp doesn't pay for the first 3 days of lost time.

    There is no problem with a return to work when you feel you can perform the duties as defined by your job/ER.

    The thing that may affect your claim though is peforming tasks outside any restrictions placed on you by your PTP. There must be a reason your PTP does not want you to RTW before Wednesday...(?)

    I'd be curious why your ER permitted to you work Monday... (?). At any rate, you cannot return to your job until Wed. when you can provide the PTP release form.
    Call/go to your PTP and get the release form.
