    Unhappy How Long Does It Take After Denial

    I have an attorney now and was denied benefits after three months of waiting.

    I had been doctoring for several years and could no longer work after trying to go back several times.

    I called for a stauts of my case and was told i just got denied.

    I have not received a written denial yet, but am really surprised with all my physical pain and issues that i was.

    I am wondering what usually happens now after my lawyer begins the appeal?

    Well J&J&J,

    This can be a lengthy process....I'm going through the same thing. At this point in time, you have obtained an attorney and the attorney has submitted an appeal. You will either receive some papers to fill out that is called a "RECONSIDERATION"....or the attorney will request a hearing with the ALJ (Administrative Law Judge).

    Only thing I can say really now is if you have any other medical records, or doctor's evaluations get them together to have submitted for evidence.

    good morning: I wanted to ask if anyone has had this concern: When i sent my files with all the papers in them, all in order to the local office to be faxed, i never received a call back from the case worker saying she had them in her computer. The one contact we had was her saying "i do not read file" ....they are scanned was rudely given to me over the phone. There were over 1,000 pieces of paper, no staples, all organized. How can i determine if they were in fact even all scanned.

    When the phone interviewer took the application she only would take 10 doctors and refused to take more. She said she had no room and that once the files we sent got there they would be added.

    I also wanted to share that the doctor they sent me to for the visit a month ago insisted i had no pain all the time and downplayed every answer i gave. He said, well you have pain once in a while, right, no, all the time. I have a bad foot and degenertative disk disease and other problems.

    He asked how far i could walk and i said, i was not sure, one or two blocks but would be in extreme pain.

    In the eye exam, i could not see the chart well and was struggling i did not have my glasses on. She insisted if she wrote i could not see it it would be put on my d/l and i would need glasses to drive. I already have it on there and do use them to drive. I have glaucoma. She again downplayed it and said she would write down my eyes were fine.

    I am so upsete and hope i can get this done on a reconsideration. I await the written denail to fax it to my lawyer.

    Are you posting this in regard to WC, or SSA/SSDI benefits...?
    I don't see your state indicated, or the type of benefits/claim you are talking about...(?)

    I am also from Illinois. The Dr I went to had to be in his nineties. Very short exam, some questions and a eye exam. In all it took about 15 min. I left the place kind of puzzled, I guess I expected more.. I filed for benefits in Oct 08, been denied twice, now I have an lawyer and been waiting ever since. But at least the ball is rolling.
    I'm not for sure, but I think if you denied three times, you go in front of a judge...

    Hi:

    Actually it is a help. Every bit of information we can get is a plus. I wondered what your denial letter said? I got mine today and it was already faxed to my attorney. I am not taking any chances of getting denied again.

    Yes, you are right the third time you go in front of a judge for a hearing, however; my attorney said that there will be a hearing for me even now going in second time with him.

    My letter was ridiculous, it listed everyone they contacted, and it was only the tip of the iceberg with all the files I sent and my fiance' and I worked on for month's. Every bit of doctor records, tests, mri's, scans, surgeries, etc., were sent. I am convinced they never even looked at the 1,000 pieces of organized files we sent after the supposedely scanned them.

    The letter said that my primary care physician was the only doctor or medical facility that did not answer. I was not surprised as her nurse told my fiance' month's ago that she refuses to fill out anything from social security. (must be nice).

    Also, they never sent one to the hospital system we use here in Indiana, I am sorry, I am Indiana, not Illinois, I had worked in Illinois and sorry I wrote that.

    They said I was not able to do the job I did before (very physical) but could do light duty. I am not sleeping, insomnia and severe obstructive sleep apnea, chronic pain from degenerative disc disease and many other issues.

    If you want to share more about yourself, please do, would be appreciative.

    They said the same thing to me also; not able to do the same work I was into but able to light duty or some less demanding job.( maybe a door greeter at Wal-Mart..lol)
    Just hang in there, everything takes time....

    Social Security Disability Insurance (SSDI) benefits are not based upon or affected by your other income or assets (means based). Disability benefits are determined by how much a taxpayer has paid into the program (payroll taxes).

    There are four levels in the Social Security Administration's (SSA) review and award system for disability. There is an additional level that takes you out of the SSA system to Federal Court, although only a small percentage of applicants will pass through all five levels.

    Yes, exactly, hang in there too and we will keep in touch. We faxed the four page denial letter to our attorney yesterday.

    Please stay positive....What kind of work did you do before, if that is ok to ask? I did heavy motor repair for years.

    Hi, BVIa, thanks for this information. Did not mean to quote here ,however did not appear to give me a choice.

    ******I am applying for SSDI not WC.....and I have done heavy physical motor repair work and other heavy physical work for many years. It took a toll on me, along with many physical problems now. I do not sleep hardly at all, severe obstructive sleep apnea and insomnia and am in constant chronic back and foot and overall pain. I am seeing a mental health doctor also and now we will enter this in as i did not do that earlier. Depression, etc., pain takes its toll on you. comments please, pray for everyone here...
