    Default Scheduled for Workers Comp Mediation

    My workers compensation claim was made in the State of: Missouri, Back injury that required surgery lost 8 weeks of work. Am at MMI now with a 25% rating as a whole and 15 % for prior WC injuries. Since 2nd injury fund is out of money what happens to the 15%? Mediation is sched for April.

    Per Atty, if they do not settle at mediation then he will take it to a final hearing and they have to settle.

    This employer is only liable for the % of PD due to this injury.
    The 25% is your current % of PD, the 15% is from a prior injury, so, your Er is not liable for that money.... only the 10% due to this injury. Apportionment to cause of PD... the prior reduces this rating. Also reduces the money due.
