    Default Settlement Amount for a 5% Impairment Rating

    Can anyone give me an idea as to a settlement amount for a 5% impairment rating for a broke bone with a steel plate and screws? Any and all help is appreciated

    In Texas your IR is multiplied by 3 so that means you would get 15 weeks of income benefits.

    That's fine for TX, but this claim is TN... WC laws are state specific, and vary widly.

    Generally it doesn't matter the type of injury, or what treatment has been provided.
    Ratings are done based on impairment, or reduced earning capacity.

    What ''bone'' was broken...? Scheduled loss is determined by body part..not bone...

    (A) In case of disability partial in character but adjudged to be permanent, there shall be paid to the injured employee, in addition to the benefits provided by 50-6-204, the following:
    (i) Sixty-six and two-thirds percent (662/3%) of such injured employee's average weekly wages for the period of time during which such injured employee suffers temporary total disability on account of the injury, the benefit being subject to the same limitation as to minimum and maximum as provided in subdivision (1); and
    (ii) In addition to the foregoing, such injured employee shall receive sixty-six and two-thirds percent (662/3%) of such injured employee's average weekly wages in accordance with the schedule set out in this subdivision (3); provided, that the compensation paid the injured employee for the period of temporary total disability and temporary partial disability shall not be deducted from the compensation to be paid under such schedule:
    A pre determined number of weeks for total loss....other awards would be reduced by the % of PD.
