    Default When is Work Comp Benefit Check Considered Late

    Does anyone know for a fact when your benefit check is considered late?
    Been getting every 2 weeks ~ this time the 2 wk period ended on 9/16
    and still no check, of course they claim it has been mailed!

    You would generally allow 5 days for mailing, either way. Beyond that...notify the CA.
    Then, as a rule, they would allow another 5 days before they would consider the check 'late' or ''lost''. Replacement/remailing of the check could take another 5 days. So you're about 15 days post the post mark. They have nothing to gain by claiming a "check is in the mail".

    It's a popular misconception that IW's are ''played'' with, or that the CA's actually have the time, or competence to harrass an IW ...we are but a number on a file. A claim to be adjudicated... thats' all. The faster a claim can be resolved, the more money saved the ER/IC.

    As usual, BvIA is right. Here's what happened to me: One of my checks was eleven days late. I notified USPS, the IC and was frightened for my dependents. The IC wouldn't cancel the check, yet issued the next one early. When the "missing" check was finally received in the mail, it had been folded lengthwise and press-curved. As though folded into a trouser back pocket, and sat upon. It scared me into seeking legal representation. We lived off Top Ramen and chicken backs for three weeks, until we got a check ahead, and have kept it that way. It's the only way to take the hammer away from them, and beat them with it. I don't know whom did what. It seems a thief wouldn't give it back, and a clerical mistake wouldn't involve someones' back pocket. All the best.

    In Florida, the check must be issued within seven days of the due date. So if the period ended 9/16, the adjuster must issue a check by 9/23. Ask for them to email you an indemnity payout and you'll see whether it's been mailed or not. If not, then you are entitled to a 20% penalty and interest.
