    Because everything in WC is based on medical evidence.
    When your treating physician submits a report with diagnosis/treatment plan and the ER/IC disputes they have the right to evaluation by a Dr of their choice...IME/Independant Medical Evaluator.

    WC is administrative law... attys are generally necessary as IW's aren't familiar with the process and where there a disputed medical issues, a judge may be necessary to resolve the dispute. You're not actually "suing" the ER for recovery of any costs you may have seen in your medical care, though those may be reimbursed by judges order.
    The WC courts have jurisdiction to resolve the disputes, that's pretty much all they do, beside review settlements for adequacy to the IW. Judges can't order settlements.
