    Default Workers Comp Doctor Keeps Sending Me Back to Work

    My workers compensation claim was made in the State of: PA

    I hurt ny back at work on March 15th and went to the ER on March 16th. I then had to go to my own Dr. because I had no contact from the insurance co. about who I needed to go to. They accepted it when they finally got in touch with me the following day! Mind you it took them almost a week to get this straight!

    When I went to the workmans comp. dr. they said nothing was broken and i could return to work "light duty". My manager is a new manager and really believes in our retail store we have "light duty". it is a sales driven store. Well that was on Monday march 21. Tuesday march 22 I had a back spasm in my kitchen and fell to the floor. My disabled mother had to help me up. I was then told I had to go back to the workmans comp. facility and not the ER to get re-evaluated. So I did this to stay within the laws of PA and to keep the insurance co. happy. The Nurse practioner again released me back as "light duty".

    My return to work was not the best. I was there for only a couple of hours and had to hold on to the counter most of the time. I then stood in front of the counter to greet any customers as this is what I am supposed to do on top of pushing sales and helping customers. I was just standing there and seen a customer who may need help so as i thought about turning to go to them ( they wernt far from where i was standing) i had another severe back spasm, legs went out from under me. I fell backwards where my back hit the counter and an ambulance was called.

    I was off for 6 days, back to work for 2 hours then back to the hospital. The comp Dr. say it is a smasm and that I can work. If this happens how can I work?

    I now have to go back to the Comp. Dr. tomorrow March 24. Can they continue to keep sending me back so that they do not have to pay me? I am in severe pain and am taking pain pills the hospital gave me. The comp. Drs. do not want to give me pain pills because i cant work with them. I dont know the laws of PA. I have heard i have to keep putting up with this for 90 days! By then my back and health can be severly damaged!

    What is there that I can do?

    When you are delayed/denied benefits in a claim, you consult with an attorney competant in WC issues/claims.
    Yes...you do have to cooperate with the system, or you risk loosing valuable benefits.

    WC insurance is the the ER, the EE/IW is merely the receipient of the benefits they are eligible for..>WC is not "health insurance" for the IW.

    Talk to an attorney...sooner than later.

    I have spoken to an attorney yesterday before i went back to work and fell again. Workmans Comp is paying the medical bills to the ER and the Workmans comp Dr.. In PA i have been told I have to go to their Drs. and their orders for 90 days. meanwhile in my opinion it is the Workmans Comp. Doctors that are at fault for my 2nd fall at work.

    Get a attorney as soon as possible as suggested.
    Do you have an written restriction that the doctor gave you, if so, give your employer a copy and follow them exactly as written. Don't do anything more than what is stated or what your injury will allow. If you're suffering back spasm's, did the doctor prescribe muscle relaxers; if so read if they will make you drowsy, and provide this information to your employer.
    Its a game the insurance company tries to play, if they get you back to work then the employer has to pay you, verses if you can't work then the IC reimburses your employer. Do as BvIA suggested, get a competent WC experience attorney, tomorrow!

    I am sure the lawyer told you that you should be provided with a list of the doctors on the employers panel. Assuming the employer lives up to their end of the bargain of providing the list and that the list contains the required number of providers, you do have to treat with a provider on that list for the first 90 days. However, you can pick from the list, and the list will normally have a hospital. Review the list and see if there is a hospital or doctor that may take your condition more seriously. Your lawyer may be able to provide some guidance as to which provider on the list he feels will be most helpful to you.

    Went to the Comp. Dr. today to be refused treatment. I had forgotten that I had been on comp before back in 1997 I suppose they said. There are times when i cant remember the day before and they expect me to remember 1997?!?!?!?

    The insurance co. is now refusing the claim. I have contacted an attorney that is local and waiting for a call back when he gets back to the office. At this point I dont know if i should return to work tomorrow or not. I am in so much pain and yet i have to pay my bills.
