    Default Whole Person Impairment and Settlement

    My workers compensation claim was made in the State of: CA.

    So I've gotten a panel QME and the doctor found that it's 100% industrial. The doctor stated a GAF of 60 which is equivalent to 15% Whole Person Impairment and is roughly 25-27% PD when rated. I'm 62 yrs old.

    Worker's comp of course tells me they won't accept my case.

    I contact 3 attorneys. The first one scheduled to see me 6 weeks out and then cancelled last minute and reschdule me for another 6 week out. I said bye.

    Second one asked for the QME report and asked me to fill out a bunch of paperwork then basically has been ignoring me for the past 2 and 1/2 weeks. Does not return phone call nor emails. What's the matter with these people? No courtesy of responding with a yes I will take the case or not I won't?

    The third hasn't responded yet and it's been a week.

    Can anyone recommend a good and responsive attorney in the SF bay area? It seems like the ones that I've hooked up with are not very professional.

    Do you think that they aren't too thrill of the 20+% PD rating? Maybe they don't believe that they can make enough money to waste time on my case?

    Help.... I'm very frustrated!

    thanks, i was hoping for someone through word of mouth to avoid finding these horrible attorney's.
    I'm wondering if they are all extremely busy or if they determine that there isn't enough money to be had for my case.

    Kinda funny, but the three attorney that i've contacted already is on that list from the site u gave me. Looks like the list contains all attorney in the bay area.

    There isn't anything for an attorney to do... they can't increase the rating... you've been evaluated by PQME...if the carrier wants to deny..then they MUST file a DOR for expediated hearing... and they'd be liable for your atty fees. An atty should jump at that...

    You can contact an Information and Assistance officer at the WCAB for help.

    Yeah, I thought that an attny should jump at my case since I did most of the leg work already. Just frustrating that these folks don't really care and leave me hanging like this.

    Maybe this may help I got injured in April 2011 and went through the Atty Refferal Program ( Bad Mistake ) , I went thru the same thing with my now Ex Attorney she did not return calls or emails eithier , So I did some checking and spoke to a friend of mine and he sent me to his WC Attorney , my friend told me when looking for a Workmens Comp Attorney find one that ONLY handles Workmens Comp. and nothing else . Well I hired him and it sure made a big difference , they return calls and emails . the bad thing is that my attorney is in Los Angeles , Ca. if you would like I can give you a number and maybe they can find you one in your area if youre in Ca.

    Is there anyway I can find out if that's all they handle? As far as I can see, these are WC specialist and they do not handle anything else.

    CAAA/California Applicants Attorney Assoc is a list of AA in your zip code that handle WC... you call the office, and ask if they handle other types of cases...

    It's not reasonable, due to the fee structure, that an AA office would not handle other types of cases..ie. PI/Personal Injury etc.

    I'll contact them and try to find another attny. I spoke to one earlier before my QME exam and the attorny named Maria basically told me that pysch damages results in a very little award and that she didnt want to waste her time. She stated that I could pursue it myself but she won't take the case. She also criticized me for reporting the people who were stealing from the company. Besides it being part of my job duty, I was being harassed by the owner who'd been complaining and threatening to close the business due to low cash flow for the company. The owner set me up and had the thieves physically and verbally harrass me before he fired me for bullying and wrongfully accusing them. I concluded that 1) the owner probably ordered his manager and assistant manager to steal money for him so that he doesn't need to report it as income and 2) He wanted to find a reason to fire me so that he could hire a younger worker (which he has after I was fired) and pay him less $$. I was the longest tenored employee and was probably one of his highest paid one as well. I overheard him talk to one of manager about getting rid of the "older" folks to save money last year. But I'd never realized that he would follow through with what appears to be an elaborate scheme to get rid of me. It's sad when you've given over 30 years of your life to a small business owner and for him to treat you this way so that he could put more $$ in his pocket. I spoke to a few discrimination attny as well and they all feel that since it's a small business, the estimated award wouldn't justify their time and they wouldn't take it on a contingency basis. What it has come down to is the amount of the potential award is not worth the time and effort. All I want is to be vindicated! Sorry to rant on.. just frustrated that there's nothing I can do unless I have a lot of $$ to hire a lawyer to fight for me.
