    Default My Employer Did Not Carry Worker's Comp Insurance and is Out of Business

    I was recently injured at work and found out my work has expired worker's comp insurance. My boss wants to just pay cash but I have scars and do not know what to do. Any ideas?

    GET AN ATTORNEY. Not having coverage for injury in the workplace or being legally self insured is illegal and does not relieve the ER from liability for the injury.

    Are scars all you have? No lasting injury, or time out of work?

    It is illegal for your employer not to carry the insurance if employer has 3 or more regular employees. You should report it to the NC Industrial Commission. In fact, you have to report it if you are going to accept any money. Doing otherwise is a crime.
    The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).

    I don't have any time out of work but I don't know about any lasting injury since a hand specialist won't see me until there is a worker's comp claim #. UGH! I am pretty sure there are tendon and ligament issues and I do not have full circulation in my index finger.
