    Default How is a Workmens Comp Settlement Determined

    I had a brain injury just wondering how much my settlement might be worth I have tons of medical bills.

    There is no guarantee of a cash settlement to a comp claim
    once you are MMI, and rated for PD/WPI, that will determime what PD indemnity weeks of benefits will be due.
    You shouldn't have medical bills...the ER/IC is liable for those medical costs to your injury.

    Do you have an attorney?

    You should not have medical bills for your work related injury, unless you have a denied claim. Either way, If you do not have an attorney, I recommend you hire one.

    That's great you will be able to return to work.
    As I said, the amount of benefits you are eligible for is not based on the type of injury, or medical provided. But, the % of impairment due to the injury is the basis for any additional benefits.

    There is no guarantee of a cash settlement to resolve a comp claim. Whether you return to work or not.
