    Default Dr. Released Me but Have to Take Meds for the Rest of My Life

    i hurt my back in 2009 i finally got to see a dr in july of 2010 and had back surgery in 2011 i went back in for another surgery to remove the rods and screws in my back in 2012 im not any better the surgery didnt help the dr released me because he said their is nothing more he can do and he told me to go to my family dr. to keep getting my meds i have to take pain pills and nerve meds for the rest of my life i also am going to go see a pain management dr next month but im paying for it out of my own pocket... i called my attorney and hes trying to tell me if i didnt have the rods and screws removed my case would b worth 60K and since i had to have them removed my case is only gonna b worth 20k please someone help me i dont understand how he gets these figures i may not be able to ever work again so what do i do ? is he (attorney) just blowing me off because he dont want to mess with me or what ? i havent talked to my attorney for about a year i only have been speaking with his secretary and for some reason i cant ever get an appt. with him ...

    you can change attys at any time. talk to a few other attys before you decide to switch.

    even tho i have an attorney will other attorneys talk to me ? on the settlement amount its not right is it ??

    your regular doctor can prescribe you any pain medication a pain management doctor can. I would at least discuss with him your need for something stronger if the pain medication he is providing is not working, if he refers you to a pain management doctor, your IC would likely need to pay for it, or fight it out in court and eventually pay for it. THey should have to pay for your medication for pain anyway. You should go through the proper channels. In the course of a lifetime office visits with pain management doctors and pain medication could easlly cost $20,000. I am confused on your lawyers thinking too. I would consult another attorney or two myself, and certainly talk to your PTP about your pain concerns. I am personally on very strong pain medications 5 different type, and all are prescribed my by PTP. I am sure you miss typed something, you said you had screws and rods taken out 2012, this year (last 6 months) and your lawyer told you since you had to have them taken out... Well, then you have spoken to him with in the last 6 or 7 months. Regardless, something is strange with what he is telling you, are you still recieving TTD, or any payments from IC?

    i havent talked to him he texted me and told me all of this and when i try to contact him i cant get ahold of him and i can never get an appt. with him i tried texting him back but im getting no response... and yes i had screws and rods taken out this year they were put in sept. of last year ... no im not getting any ttd because the dr released me i am not getting any payments from w-c i am paying for my own meds and dr's that i go see ... i cant get ahold of my attorney to talk to him to tell him all this stuff and i have to have my meds so i have just been paying for them... i just dont understand how taking the screws and rods out of my back could make my settlement go down that much and i have to be on meds the rest of my life... i cant get any other attorney to talk to me because i have an attorney already so i dont know what to do...

    I just don't understand why you are paying for your own meds. Your surgeon told you to go to your PTP for them, he obviously is prescribing them, did the IC just start denying them at some point? THere are benefits after MMI for medical. I do not know anything about Oklahoma. If you say you will be taking medication for the rest of your life, obviously a doctor told you this, so I don't understand why you are paying for the medicine yourself, either it is part of your injury, or if they are claiming it is not then your regular health insurance should be kicking in on it until it is straightened out. Obviously your lawyer is a real bad attorney, because this seems to be something he should be all over. Did your surgeon say he would not prescribe drugs for you anymore, as in you no longer need them in his opinion and to go to your regualr doctor, in which case the IC would have grounds to have stopped paying for them? I can understand the difference in needing the plates and screws perminately in your back being a more serious condition than one where they are removed, yes.

    I understand now about not talking to your attorney, I was confused because you wrote that you called your attorney, and he said...I have not spoken to my attorney in over a year, but we e-mail regularly, usually once every 2 months, as there is nothing going on in my case right now. Try sending registered letters to your attorney and ask him to answer your questions. Most lawyers seem to prefer to relay information through e-mail now, with important information also e-mailed, regular mail, and in my case a phone call for things like appointments being scheduled for IC doctors. If you don't have e-mail, the texting from your lawyer would make since, but it would not seem to be anyones preferred method of communication outside of high school ( not cracking on you but wondering about your lawyers professionalism). You didn't comment on why you are going to see a pain specialist as opposed to your PTP just prescribing drugs for you, is he not prescribing them anymore?

    You can always consult another attorney, but attorneys are very wary of discussing settlement amounts, they don't want to be told later you told me this or that. They will discuss what they can do for you, such as securing benefits for you, which you seriously need done, and long term benefits, how they would possibly look to bring your claim to a long range conclusion, and long term options with you. If done of this has been discussed with you by your current lawyer you are being misrepresented in my opinion.

    i was told by my surgeon i have to take these meds for the rest of my life but there is nothing more he can do for me so i need to take it up with my family dr. and yes i have an email but emailig my attorney is another story his sceretary chks his email and i dont ever hear back from him i dont understand why i am paying for my meds either and i cant get ahold of my attorney to find out ... my surgeon told me if i cant get my family dr to presribe my meds to call his office and he would see what he could do because i have to have them ... my attorney is very unprofessional i dont know what to i cant get another attorney to talk to me because i have an attorney already even tho hes not a very good one i still have an attorney... my family dr wants me to go see a pain management dr to see if my pain can be controlled better another way besides taking meds for the rest of my life.. i dont know why my surgeon didnt send me to one but he didnt so now i really dont know what to do besides keep paying for it until i get a chance to talk to my attorney which who knows when that will be.. i call his sec. and hes never in the office or hes busy there is always an excuse for him not to talk to me its crazy to me and i have tried to understand why hes beening the way he is but i cant.. i know he has lost several clients because of his actions ... and if i cant get another attorney to talk to me then im kinda stuck with mine until i dont know when... i have several txt messages from him discussing my settlement amount before i had the rods & screws removed and i talked to his secretary when i found out they needed removed and she said he told her nothing would change and we would have to see the out come of the 2nd surgery as far as furture medical problems... he said he would call the w-c to see if they r ready to settle and i txted him back to let him know i am not setteling for that amount and i still have to go get a rating ... he wasnt even gonna send me for a rating his secretary said he hasnt even looked at my file for about a year and i told her to tell him to look at it before he try's to make any decisions on my settlement ...im just so confused and mad because i hurt constantly and hes not even trying to tell me the options i have it just dont make any sence...

    there is little that can be done as long as you've given this atty the power to make comp decisions for you.

    i didnt give him the power to make comp decisions for me i hired him to make sure i dont get messed around by workers comp and he is suppose to talk to me before any decisions are made ....but thank you for your info...i appreciate it even tho i am still in the same situation i still dont know what to do...

    You need to mail copies of your receipts for medicine to your lawyer and your CA and request reimbursement.
