    Default How Much Money Do You Get for an Injured Finger

    i cut my right index finger almost to the bone. it severed the nerves and i do not hve any feeling from the middle knuckle to the tip of my finger on the top side. I do hve most of the feeling on the bottom of the finger. The workmans comp doc advised agianst surgery since i still hve feeling on the bottom of the finger. Most likely i will never hve feeling on the top side of the finger. No MMI yet. I was outa work for 60 days and got workmans comp weekly benifits for it as well as hospital bills paid. The physical therepist thought i should be outa work another month but the doc said i hve to goto work in a week. If the feeling doesnt come back by MMI then how much should i try to get as a settlement. The fault of the accident was mine and no drugs or alcohol were involved. I just cut myself while installing a dryer cord. I am able to move the finger with a little stiffness but its hard to work that hand with a numb finger. thx for your time. BTW i am in N.C.

    if you are returning to your old job then you'll have to wait for a rating after you are at Maximum Medical Improvement.
    you can't get a rating on a public website by anonymous posters. ratings are complex and have to be done by an experienced doctor.

    The doctor will give you a rating. About the best you could hope for with that injury is probably 40% or 50% to the index finger. The index finger in NC is worth 45 weeks. (NCGS 97-31) So, if your rating is 40%, then the PPD will be worth 45 times .4 = 18 weeks times your weekly compensation rate. If your weekly comp rate is $400, for example, a 40% to the index finger is worth 18 x $400 = $7,200.00.

    But the rating is not necessarily your best deal. In NC, if you qualify for lost earning capacity money, or ongoing TTD, then you get to choose the benefit that gives you the most money. And you can get a second opinion on the rating from another doctor if the treating doc obviously lowballs your rating. After you get rated, it is probably a good idea for you to get a free consultation from a NC Board Certified Specialist in Workers' Compensation attorney, to get some specific legal advice.
