    Default Got MMI but My Boss Wont Fire Me or Let Me Return to Work

    Im in Il, on workers comp for a umbilical hernia repair . Its been 6 weeks now, went through all proper steps to return to my job. my boss wont answer my calls or return them. I am MMI, and now out of TTD payments and no income. My WC lawyer says that he,s talked to their lawyer and cant get an answer if I am fired or when they will let me return to work. Also this job doesn,t pay into unemployment benefits. Now , my lawyer says he,s stuck. How do I fine out if I was fired while out on workers comp? and what should I suggest to my lawyer?

    The ER doesn't pay into UI ?
    Go file.. what ER doesn't pay into UI program...?

    Can't tell ya what to suggest to your atty... he knows the laws, your file claim/facts....
    You don't need to be fired, if you have wage loss, either PD or UI is due.

    Your PPD should kick in once you reach MMI, your lawyer should know this.

    Benefits for Permanent Partial Disability (PPD)
    The percentage of worker's wage paid is 60. For weekly payments, the minimum is from $213.33 to $320.00, according to number of dependents, or worker's average wage if less. For non-scheduled payments, the maximum period of payments is 500 weeks if the worker is able to pursue usual work duties or the duration of disability if unable to pursue usual work duties, and there is no maximum payment amount.

    I would suggest he do his job or refer you to a lawyer that knows what in the hell he's doing.

    This employer has no intentions of bringing this employee back, that train left the station long ago.
    The poster said "Its been 6 weeks now, went through all proper steps to return to my job. my boss wont answer my calls or return them."
    This employee isn't required to get on his knees and beg nor would I recommend it.

    He's done his part, it's time for his attorney to do his and file for a hearing to get his PPD started.
    This employer should be treated as hostile, they're trying to screw you out of your PPD - have no further contact with them without your attorney's presence.
    Do not do anything unless instructed to do so by your attorney.
