Mileage Reimbursement
When I origanly hurt my back my employer told me to go to any surgeon I wanted to because they had no spinal surgeons in their book's so I found this surgeon out of Pittsburgh , the trip was 240 miles round trip they paid for every visit . After this surgeon refused treatments after my non-union and a broken pedical screw I found this other Dr. who was just as far as this prior Dr. was . I could not find a spine specialist in our local area because I have had a fusion , no Dr. would even see me for an opinion. So I started seeing this Dr. and comp refused to pay me mileage for my visits , I ask my lawyer about it and he said since there is spine Dr.'s in our area they don't have to pay me...After looking at different forums I found they have to pay if I can't find a local Dr. to treat me so I call my lawyer back up after a year and mention this to him and he say's ," Oh boy your right ...So now my lawyer wrote a letter to the insurance companies attorney and said I should be reimbursted for all my trip's from 2005 till present , they add up over $2,000.00 . he told them if they have a problem with paying me he will file a petition with the judge.
Do you think they will pay for this ? Gas prices are so costly and I don't have alot of money. There attorney is on vacation until the 26th so I guess I'll know more shortly after ? My attorney said this may speed up the settlement demand but I'm not sure about tht if I can collect SSD ontop of my comp check's , I won't need to settle.
