Default They Say He is Fired Because the Fmla. He is on Workers Comp

My workers compensation claim was made in the State of: Minnesota...

His work called and said he is fired because the family medical leave act time limit is up. He has been on workers compensation for 3 months and is about to go into surgery for his injury.

How does family medical leave act work into this? Is this legal? Can they fire him for something he is not using and can they cancel his benefits?

getting workers comp benefits does not require that the employer hold or create a new job for a worker.
FMLA is not insurance. it's a law that protects workers who have not been at work for up to 12 weeks. it prevents those who've left their employment due to family and medical reasons from being terminated immediately.

Same thing happened to my husband after 10 months of his wc injury. It is stunning but ya, they can do that.
