HI well we met with our lawyer today and we are going to propose a loss of wages from the time my husband was off and only getting unemployment. my husband ask if this could lead to a resignation even though its only a lost wages settlement and a petition for penalties. THe defense wants my husband to settle out now and our lawyer said no way because of his pcp still treating him. What i was asking is what are the odds of being forced to resign for only a portion of the settlement?
  4. This may be considered retaliation if your husband is being treated differently from similarly situated employees just because he filed a WC claim. You should certainly talk to your lawyer and he may want to send them a letter pointing out this fact.
  5. Hi its me again my husband has an ongoing case with his er. Its a wc injury and he was offered a light duty job and of course he had to go back to work or lose everything including unemployment benefits. Will they put him back on 3rd shift and today he was advised that he has to keep track of everything including when he goes to the bathroom and when he gets back. He has to write the times down. Is this acceptable considering he does work alone? The current man who my husband is replacing because he is leaving the co never had to do this.Is this considered workplace harassment? and should we contact our lawyer or just wait to see what the days ahead bring?

  7. My husband was offered a light duty position just this week after being off for 3 months due to restrictions from his pcp. Will he still be eligible for back lost wages? he was receiving unemployment. Also the defending lawyer put these wages on the record. Can they deduct this from a possible settlement?
