    Angry Crooked Doctors

    On 04/04/2007 I got injured on the job I reported it immediatly to H/R where I was given the choice of (5) doctors when I chose one of them I was told that "that doctor I would be waiting all day and I should see this doctor".Anyway I was in such pain that I accepted when I got there what I seen was a nurse practitioner that tried immediatly to say I was having mussle pain in my neck.I immediatly told her that it wasn't in my mussles but in my spine she started arguing that all I was experincing was mussle pain without any tests.So she finnaly decided to send me for an x-ray.After the x-ray she proceeds to read it she tells me she see's an old childhood injury and arthridis in my neck but no injury.I looked at her and told her that I havenever had any problems with my neck arthritis or childhood injury to the neck and I told her so.She got angry and told me she was setting me an appointment with a specialist.Well I went home and I wasin so much pain and after realizing that I was getting jerked around I decided to call an attorney.Next I get a call telling me I got an appointment with the specialist 04/16/07.He tries to order an MRI and workers comp refuses to pay for it.The doctor wanted to read it while I was there.Workers comp. said they already ordered one because they wanted one with "contrast"that's the dye they use looking for cancer.Because I have had cancerabout three years ago in the mussles in my lower back but after two surgeries and two months of radiation it was all gone.Well to their dismay they found no cancer in my MRI.So they moved from one excuse to another.The specialist read my MRI and tells me that I have a buldging disk and whiplash like a car accident gives me pain pills and a prescription for a cirvicle collor"neckbrace"and sends me home with some vague work restrictions and on the return to work papers he writes c/t strain and D.D.D.which means "degenritive disk disorder".Well that's all it took the next thing I know I'm being pulled into the office and being told that my injury was preexisting and all I have is of course mussle pain.And now I'm being harrased.Anyway is there a way to get a doctor to treat you instead of the company and workers comp.or at least your own doctorone for you not them.

    Hl2164, Get yourself a good WC specialized attorney that will work for you. First off DDD is Degenerative Disc Disease. It is a catch all phrase that is a two edged sword. As we age we all have some form of degeneration in our spine and other joints however this does not necessarily have to enclude buldging, herniated, or ruptured discs. Google degenerative disc disease and read up on it for yourself so you can have a better understanding of what it really is. You need to call your attorney NOW and proceed based on his/her recommendation. Don't fool around with that NP who works for your company. The MRI should have told them all they needed to know and the specialist you seen sounds like he is on the take to me. Don't take the harrassment from your ER sitting down, get up and fight for your medical treatment and any other WC benefits you are entitled to by TN law. You should be entitled to a second opinion at the very least. If your attorney isn't making things happen for you perhaps you need to find another attorney.

    Under Tennessee law, the employer or insurance carrier is not required to offer a second opinion; if asked, however, the insurance carrier or employer may provide a second opinion.
    The employee may always seek a second opinion or obtain treatment with any physician at his/her own expense; however, only the restrictions of the authorized doctor must be followed by the employer.

    Put your request for a second opinion or a change of treating doctors in writing with a copy to your attorney and save a copy for yourself.

    2164, Not sure what part of TN your in but being as how i am close to knoxville I got a lawyer from there,and not sure what company your working for but they will be part of the fight. I have been dealing with WC since before the laws changed more in favor of the insurance companies and still they have a couple steps up on you.Be sure and i cant stress this enough to have everything the Dr. says to you recorded either on tape or on receipt they give you.And you will find treating physician has more clout in what they say then any other when it goes to a hearing.the first Dr i went to said one thing and three years later when we went to court judge ruled differently , still not sure howas we had everything written down and even had a case worker assigned that wrote in her notes all that the drs. said. GET A GOOD WC ATTORNEY!!!!!!!!!!!!!the company you work for and their insurance carrier will have the best their money can buy!

    I ended up going to a Dr. not on their list and had insurance cover the cost after i was released from WC Dr. and still fighting for medical!GET A GOOD WC ATTORNEY!!!!!!!!

    Let us know whats happening and make sure you stay informed of whats going on in your case.GET A GOOD WC ATTORNEY!!!!!!!!!!

    Tennessee decided three years ago that it was better for the economy of Tennessee to curb IW benefits which would lower disabilty premiums and draw more business to the state.That in itself should show you what you got to look forward to as far as for help from WC
