    Default Is This Normal With WC IC?

    When the ortho doctor tells you that he cannot do anything else for you, and says you now will be sent to a neuro; yet the NCM says that they can't get a neuro until they get the MRI's are taken. Do they normally stop WC payments in between the ortho doctor and the neuro doctor?

    I think since the ortho idiot stopped seeing me, that the WC pay has ceased, and no Neuro appt has been made, they have stopped payments.
    Is this another one of their practices?

    temporary payments stop once your at mmi.

    Maybe I didn't word it just right.
    The ortho doctor told me since I didn't need orthopedic suregery on my ankle, he would have to pass me on to a neurologist that can help me with my neurological problem. They said they could only treat one thing at a time. Instead of starting at the top, they started at the bottom and are working up.

    Lue, I think if you PTP has referred you to a Neurologist AND your PTP has not yet determined that you are to be released back to work, then you should still be receiving TTD. Do you have an actual copy of your PTP'S most recent report? This might shed some light on your TTD status.

    I am not sure if under Tennessee WC Law that a PTP can just "decide" to no longer be your PTP, at least until a TRANSFER OF CARE has been made with the appropriate specialist. I also believe that it is incumbent upon your PTP to ARRANGE FOR THE NEURO APPT/CONSULT/REFERRAL, although sometimes a CA will make the appointment.

    As a treating Doctor, regardless of being on WC or NOT, if a Doctor no longer "wishes to treat " AT ALL and wants to "sever" the patient/Doctor relationship, then he must advise the patient IN WRITING and give the patient thirty days Notice to find another physician. In the interim, while the patient is TRYING to get another treating physician, that Doctor can NOT refuse to render medical care... Maybe the rules of ethics are different in Tennessee, but I doubt it.

    Get a copy of your PTP's most recent report, photocopy all your WC TTD stubs, and try faxing the info to your attorney so he can contact your CA and determine if there is a LEGAL BASIS for discontinuing your TTD while you are awaiting the Neuro Consult.

    I got out the sheet that the doctor's office gave me when I left. It is a carbon copy, and it is so hard to see what he wrote. But...
    Beside the "Full Duty" line, it did have that days date. Grrrr! But it also said something about a neurologist.
    Then it does have MMI on ths sheet also. And that date was the same.

    So I called atty office and told them what I had found. I thought I had gone by there and let her run it off. She said not to worry since they have told me to go see a neuro and an MRI first, that it covered me. But she suggested that I call the CM, since she could still talk to me.

    I called the CM and she said the doctor had not released me to go back to full duty, but to a neurologist. But yet he still had full duty listed instead of "off work.'' Either Dr Dumb filled out the wrong part or the CM is messing with me. Looks like IC took it that he released me.

    The atty office is calling CA and finding out why they have not offered doctors, why the wrong MRI and why have checks been stopped.
    Hopefully this will get things cleared.

    That is what I get for taking them at their word. Makes me look like Dr. Dumb's assistant!!!!

    Lue, you need to get a copy of the ACTUAL transcribed medical record from your last visit....it sounds like the Doctor gave YOU the "boiler-plate" work note.. and what is on that note, and what he documents in the medical records that he must send to your CA may also help clarify what the heck this Doctor is advising. Might take a while, depending on the "turn-around time" of your Doctor's transcriptionist. In most cases, it usually takes one to two weeks, depending on the work-load of the transcriptionist your Doc uses, and if he has someone IN his office doing transcription, or he "ships it out"...

    Lue I think JLJ would be the best one to answer that question but it sounds like to me they are just trying to force you to give it up from what i've read the only way they can stop payments is either MMI or your not being compliant with medicals and he can't possably put you at MMI and still refer you to a neuro thats not closing your case and saying thats all that can be done for you but that thats all he can do.He can't have his cake and eat it to if he has refered you then your not MMI.He's just saying that he's through with you.Same thing happened with me and I haven't seen that ortho that I shouldn't have seen to begian with since.And I was not put at MMI.Call your attorney and if you don't get the answers you need then contact the department of labor,but I would let your attorney know that you intend to do that if he can't take care of it for you.May get a fire burning under his but.Try your attorney First.

    Lue;sounds like to me their trying to pull a fast one even dumb Dr.'s don't make that many mistakes be carefull.
