    Default Settlement Amounts

    I am a 40 yer old const worker. I was injured when I was 38. I just learned that my disability rating is 94%. I recieved 284.41 for weekly benifits until I just recently reached MMI. I do not have a lawyer and have no idea what to expect.. ie settlement amount, process that happens next, life time medical, etc. any help would be appreciated

    what part of the body? 94%?


    Scheduled Injuries


    Thumb 60 weeks
    First or index finger 35 weeks
    Second or middle finger 30 weeks
    Third or ring finger 20 weeks
    Fourth or little finger 15 weeks
    Great toe 30 weeks
    Any other toe 10 weeks
    Hand 150 weeks
    Arm 200 weeks
    Foot 125 weeks
    Leg 200 weeks
    Eye 100 weeks
    Hearing (one ear) 75 weeks
    Hearing (both ears) 150 weeks
    *Body as a whole 400 weeks

    *The 400 weeks for body as a whole is
    used for a maximum for Permanent Partial
    Disability (PPD) but does not apply to
    Permanent Total Disability (PTD).

    I had a spinal cord injury. I am an incomplete paraplegic (with what is called a burst fracture of the L1 vertebrae)I have very limited use from the waist down. No function of bladder-bowel, no function from knees down.
    What is the difference between PPD and PTD? Thanks

    You need a lawyer, and you need one immediately.

    I'd say it's very clear with the nature of injury that you have that you are permanently and totally disabled.

    ppd=permanant partial disability
    ptd=permanent total diability

    but do not take case yourself i did mine byself because i knew the laws and what to expect but you on the other hand need medical care among other things and only a lawyer can insure that.


    if you are able to get back to work they will offer a min of $106938.16
    if unable to return the max will be $641628.96
    this will give you ideal what to expect but you still need a lawyer i advise highly on this and i say alot of other people will tell you the same thing. but keep in mind a lawyer can get up to 20% of your settlement plus expenses which is standard. also free consultation so use them till you find a good one...

    When you say able to get back to work do you mean the same or similar job or a different type job that I can do in my condition?

    my recomendations is take JLJ up on his offer ASAP especially if you have no attorney.

    And if he's in your area hire him because he's good and the most important of all things he cares about what he does.He would have to any attorney who gives as much of his time and knowledge as he does has to care.
