    Default Legal Question About TTD

    I was originally awarded TTD after filing paperwork with the TN Dept. of Labor; however, they only gave me 3 weeks as they say I turned down a reasonable work offer. The work offer I was given was only a temporary 3 week job that I did not feel met my restrictions. The job was in another state, approximately 45 miles away, and driving that far of a distance aggravates my medical condition. I sent my attorney the letter from the state and thought he was going to appeal the decision. By the time he finally got back in touch with me to tell me how to fill out the paperwork myself, it was past the deadline given by the state. I had assumed he had already submitted the necessary paperwork for the appeal. According to my attorney, it was not unreasonable for the company to expect me to drive that far and that I should find other transportation to and from work. Since there is absolutely no public transportation system available to the work destination, that was not an option for me. Also, since the job was only for 3 weeks (which would have ended the first week in December), shouldn't I be eligible for TTD benefits after that time period? Does anyone have any advice on this subject?

    well it is one of those should i shouldn't i. well they offered you a postion that fit your med requirments and you stated you did not do it then it is possible that is a negative mark against you.. transportation is hard but unless the doc says unable to drive then you have to drive. You probally not be able to receive benifits because of those reasons you failed to comply. I am sorry to say. you lawyer probally did or will tell you the same thing. It is like any other job if you don't do it they fire you. you might want to look over your paper work and find some lea-way or contact your lawyer again and tell him situation and all. he might have a ideal. but from what you stated i have no good ideals for you..

    Depends on your work restrictions.
    If you can still show medically approved limitations then maybe.

    My restrictions are "limited use of right arm". Would I still be ineligible after the time the job ended as it was only for 3 weeks?

    I guess I need to clarify my restrictions somewhat....from the time the temp job ended on Dec. 5th until Jan 10th my restrictions were "limited use of right arm". Since that time my restrictions have been that I can only work 4 hours per day, 5 days week with accomodations made to the work area as well as frequent breaks to do PT exercises. I have not been terminated by the employer, I work for a temp agency & they just don't have any work that meet my restrictions. I can understand how they could get out paying me for the 3 weeks but don't understand why they don't have to pay me after that time period.

    If they've denied payments then you can appeal to the work comp commission.

    There is no "workers' compensation commission" in Tennessee. After the initial Request for Assistance is granted or denied, either party can make an appeal of that Specialist's decision to the TDOL Nasvhille for a higher tier review.

    After that, your only remedy for any of those issues would be through the court system.
