    Default Attorneys Fee

    I'm settling a case for a lump sum payment do I have to pay a portion to the attorney or does the insurance company pay them?

    Your atty fees are coming from your settlement money. The ER/IC is not paying your atty fees. They may send the check, but it's your dollars.

    Also be sure to check your states WC statues to determine IF your attorney is entitled to get a cut of any FM payments. Most states do NOT allow attorney fees for the payment of the medical portion of your settlement.

    Those laws don't always prevent an AA from attempting to get a peice of the FM pie as well as the indemnity portion of your settlement.
