    Default What Are Death Benefits in Oregon

    A man is coming to see me soon about a family member who was killed in an accident in Oregon recently. I think that either NC or Oregon will have jurisdiction. Does anyone know what amount is paid under Oregon law for a death claim?

    I just found Bulletin 111 on the Oregon agency web site, and it seems to give a good overview of the death benefits.
    The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).

    There is help for IW's though the Ombudsman...

    Relating to death benefits paid in workers' compensation claims;
    amending ORS 656.204, 656.218 and 656.262.
    Be It Enacted by the People of the State of Oregon:
    SECTION 1. ORS 656.204 is amended to read:
    656.204. If death results from the accidental injury, payments
    shall be made as follows:

    There isn't a lot showing up regarding death benefits on the OR WC site... maybe, hopefully, not many OR IW's suffer death due to job duties.
