    Steel, that is fab information to have! Thank you very much. I also thought it was weird that a comp attorney would advise for the 30 month delay when language can be written in the settlement to include pro-ration.

    If you get a lump sum they require you to sign a document stating you will not get SSDI for 30 months.
    That attorney could find his ass in deep potty, so could the CA/IC/ER and any other party to this...
    You cannot sign away rights or responsibilities... just the application for SSDI triggers the WCMSA issue. Even though you may be in the appeals process.
    Failure to address Medicare interests, or report a settled claim can result in fines/penalties up to $1000 a DAY..yes a day.
