Injured at work. Ruptured and herniated disks in cervicle spine. Failed conservitive treatments and had surgery. The workers comp. doctor only fixed one of the disks. Still in pain post surgery and I kept insisting something else was wrong and the workers comp doctor MMI me anyway and because I was still in pain within two months I was put in treatment with pain clinic where I have been put through every conservitive treatment they have except for spinal cord stimulator. Was released from my job due to so many permanent restrictions. One of the workers comp specialist noted that until they address or resolve completely the neck problem that there could be no significant lasting relief. And a unbiased IME has been completed noting that I should have a surgery on the other disk as well. I have been in tremendous pain for two years and in doctors care the whole time. With the primary workers comp surgeon saying he does not know why I am still in pain and defending his surgery I know he has washed his hands of my situation because I feel he does not want to admit he was wrong or that he totally represents the insurance company and not the patients he has an oath to treat correctly and ethically. I am focussing on getting better but the fact that they are going to make me go to another workers comp doctor to get their opinion makes me feel as if they are going to try to discredit the other two doctors by making it two against two. Why don't they just fix my issues that are work related and let me go on with my life? Can you sue a workers comp doctor for mal practice? (failure to diagnose correctly, failure to treat or respond to patient issues, etc) Can workers comp have to pay back unemployment because I should have been on workers comp benefits the whole time? I am just so full of anger over all of this. I have panic attacks and headaches at least three a week. I am seeing a counselor and trying to help myself not worry. I would love to be able to expose the corrupt system. Because so many people have lied to get money I feel the injured are punished by the delay tactics of the insurance companies and them trying to protect their bottom line.
