    My workers compensation claim was made in the State of: Texas

    Can I file for unemployment while waiting for the insurance company to kick in?

    If you're ABLE and AVAILABLE to seek employment, most likely, YES. Once the benefits kick in from WC, there would be an offset of the UI benefits.

    There may be more specific rules in Texas, and perhaps somebody here from that State will be able to get more specific.

    If your Dr has you on TTD/Temp TOTAL Disabiliy status... you are NOT eligible for UI.
    If you are TPD/Temp PARTIAL Disability, with the ability to perform light duty or modified job, you should go back to you ER for that accommodation. You may be eligible for additional wage loss benefits.
