    I was injured at work on 3/29/04 heniated several cervical disc and was fused from C4 to C7 with no relief from the pain. I had a lawyer Glenn ward he handled my claim and I kept telling Dr Fischer I was still in pain. He called me a bad penny because I kept turning up. Well that did'nt sit well with me and i got another Dr so I could get this pain problem fixed. Well after a couple years of him telling me that surgery may or may not help so I went to another Dr. He did another surgery on my neck in nov. 2011 I was now fused from C3 To T2 and It did'nt help with the pain. Just to jump backwards a little. I had two surgeries in 2004 one too remove the hardware from a previous surg. in 2002 for herniated disc at C5-6 not work related. And put the new hardware in through the back of my neck. Ok back to main topic. I have an 81/2 inch scar and I have no lawyer because Mr. Ward told me I was fine where I'm at because they will not settle and everythings in place so he closed my case with there office but it's still open with w/c. I'm on my own and need some Idea of what to do next. I want to settle disfigurement again. I settled in 2007 for disfigruement and permanency. But since i've had to have another surgery for the same injury I need to get the right forms to fill out for disfigurement. Delaware's w/c site is baffling to me. Anyone know where and what forms I will need to get disfigurement and hopefully settlement too. Please help me. theg6969

    unless you formally dismissed your atty with the comp court they are your atty of record.
    whether you can reopen your claim after your 2007 settlement depends on how it was done. a cash buyout of all benefits would close your case forever with no option to re-open for more benefits.
    if you are eligible you would need a petition for additional compensation.

    He did'nt stop being my atty. until 2009 and I have been dealing with the w/c lawyers since thenand after my last surgery in 2011 The w/c adjuster called me and asked for the surgery date and not even a week later they raised my payments to temp. total dis. Without me having to contatct them. But the lwayer from w/c for some reason is no longer with the firm and now I have to deal with a new one. I just need to know what forms I would need to settle this surgeries disfigurement. The surgery in 2011 is connected to the work injury of 2004 so the scar on the back of my neck is larger and you can see it because I wear my hair short it's 81/2 inches long the scar not my hair lol and since I had to have another surgery this also puts me back as it was with the first claim I'm guessing. Because they never said I could'nt get it and my Dr who did this last surgery said in my last report from may that i'm totally disabled and it looks like hhe will be totally disabled permanently and that's in his words. So I'm trying to get the right info. on which and where to get the forms I need to file for disfigurement.

    There was no cash buyout of all. I got permanency and disf. Still have medical and wages still it's not a closed case.

    I don't know how your comp act works in DE, but in NC you would get a whole lot more money for total disability than for disfigurement. You should get a DE work comp lawyer to help you evaluate the worth of settling your claim. Otherwise you are shooting in the dark and are not likely to hit the right target.

    It's the same here. I just want to know what forms I need to get my disfigurement settled. I had a lawyer up until 2009 he said everything was set in place so there was need to keep my case open with them not w/c. So I had to have another surgery for the same injury in nov. 2011 I'm now looking for disf. and perm. I just need to know what forms I need.
