    Default Forced to Work While on Narcotics

    I have a torn rotator cuff and I went to 2nd opinion md he said I could return to work with restrictions but I am a nurse and working while on narcotics in arizona is against the nursing rules. My adjuster is ignoring the fact that nurses can't work under the influence of narcotics and just sticking to what 2nd opinion md said . My Md wrote to be off because of this. But she is ignoring this also. I called Ombudsmen and she said I will have to file for a hearing. Any advice ?I have no money and she refused to pay me for month of June because of 2nd opinion on 6/26.

    Hire a WC atty because you will need one to help you with your hearings and your benefits. The second opinion doctors are always used to deny claims and payments of wage loss but you have a hearing on the matter. Your atty is not going to charge you they are paid on a contingincy basis. As complwyr posts get one who is not afraid to go to trial.

    You need a competent workers' comp lawyer now.

    Hire one tomorrow if you can. Do your research about lawyers. Good places to check them out are Martindale.com (look for an AV rating) and AVVO.com (read client reviews there) and also Superlawyers.com and the Best Lawyers in America website. The "find a lawyer" button on the homepage at www.WILG.org is also a good place to look.

    Thank you for the good advice. I will consult a lawyer if they will help me sometimes they like the big money cases. Wish me luck.

    Well I talked to my attorney and she said it would cost twelve hundred dollars for a labor specialist. I just don't know if its worth fighting it. I'm using my pto at work when I can't tolerate it any longer.I just want it to be over.
