    Default Can You Return to Your Job After a Worker's Comp Leave

    My workers compensation claim was made in the State of: HAWAII To whom it may concern I have went to court for workers comp waiting for a decision to be rendered in the mean time my employer will not let me return? I applied for a Partial Unemployment and my employer Avis would not return my weekly reports as well as they told the Unemployment office that I am on a LOA Or workmens comp leave??? and I was not available for work??? First of all I have not been approved for Workmens Comp and I was denied for FMLA?? And In Febuary 2012 I recieved a letter from my employer telling me I was denied for FMLA and they will only give me 2 months LOA after Febuary and I must be able to perform job duties because they do not have to accomodate me?? Also I called Department Of Labor which they were the ones that told me to apply for a partial unemployment and they called my employer and the unemployment office on my behalf. And the next day I woke up and I checked for my unemployment I was denied?? Also My employer claims to not even know who I am to file my LTD claim with??? PLEASE CAN SOMEONE PLEASE HELP ME I LIVE ON MAUI AND EVERYONE I MEAN EVERYONE KNOWS EACHOTHER I DO NOT KNOW WHO TO TRUST OR WHO CAN HELP ME!!!

    Hawaii is the worst state in the union when it comes to Workers Comp, workers rights or anything to do with with helping the needy or disabled.

    I've yet to find any resources or attorneys on that island to help injured workers.

    I am a member of WILG and this gentleman is active in WILG. He handles work comp cases in HI and based on what I have seen from him on the WILG listserv, I think you can rely on him to take care of you. Give him a call:

    Jayhawk, Tx and Fla are pretty bad too....

    I second this opinion. Doug is my attorney and I could not have maintained my sanity through this process withou his help.

    I am not sure what my employer will do now?? I have been blessed from the universe above I have WON MY CASE!!!!!!!!!!!!!!!!!!!!!!! I GOT MY DECISION LETTER AND I HAVE WON!!! I really hope my nightmare is over somehow I have a little feeling it is not over yet. I really have a bad taste in my mouth for the Avis Budget Group which is the company I work for here in Kapalua, HI. With that being said I am really afraid to have to work for them and don't want to they have truly showed me their true colors while in the nightmare I was going through. But The Truth has prevailed and I have been vidicated.
