    Exclamation How to Complain About the Handling of Your Worker's Comp Case

    How do you file a complaint against your local Work Comp office or Specialist? Would it fall under State Commission? Thanks in advance.

    it depends if it's a public or private entity. if it's a public entity you would contact the agency head.
    to file a complaint against a person, write to the supervisor or manager.

    If you're talking about filing a complaint about something done by the Dept. of Labor in handling/processing something about your WC case, there's really nothing substantial that would be done. You can't file a lawsuit against them, because as agents of the state government, they fall under something called "sovereign immunity." That basically means that you can't sue the state because of something that was a part of the functions of their office.

    If you just want to vent to someone about the way you felt you were treated or mistreated, you can always look up the information for the Dept of Labor and make complaint to the higher ups in the Department.

    Take your complaint directly to the department of labor if it involves not getting timely results, being denied care, etc. Talk to your adjusters superior if it is the way your adjuster is handling things.

    I have had to do both. Both ways I have gotten immediate results.

    The WC office doesn't handle a case, an/your attorney does v. the employers attorney/insurance co. The ARDC, Atty Regist Disciplinary Comm, in Chicago has a form to fill
    and must mail...that will get the weak attorney's attention...best of luck.

    What does an agency in Chicago have to to with a Tennessee work comp claim?
