    Exclamation Lower Back Injury With Disc Protrusion

    Hi i hurt my self at work a yaer ago,from my lower back, acording to the mri my "l5-s1 disc protrusion" i have been in many diferent doctor's i saw 3 diferent surgeons and both say that im not candidate for surgery wich is goo to know but the thing is the im sufering from alot of pain they did 3 epidoral shot on my lower back, they schedule me to have another epidural shot this month. The doctors are saying that this is from previos injury wich is no right i have never had another unjury in my back also they are saying that after the shot they are going to schedule an fce functional capacity evaluation to determinate rtw retur to work because they are expenting mmi max medical improvement after the epidural shot. But i have no do any better yet so i dont know what to do or xpect any one can help me please or give an advice please remember its been more than a year no working either.

    if the doctors believe there is no treatment that can help or improve your condition then your recovery is stalled and will be rated for additional permanent disability benefits.
    medicine can't cure every situation.
    send a written request to your employer/carrier requesting vocational rehabilitation and/or job placement benefits:

    I read your thread and I was curious to know if these doctors that state your "injury is from a previous injury", are they doctors from occupational health, w/c doctors, or were these doctors your choice? That could make all the difference in the world. Also do you have an attornery? If you don't you need one to consult with ASAP! What are your restrictions going to be if you end up MMIed? You must know this as your job may not be able to acommedate your restrictions. I wish you well.

    yes this doctors are the one that workers comp adjuster send me to see so i thinks they are w.c doctors thats why.

    since they are paying for everything doctors,medical bills,medicine, biweekly check. i didnt think i need a attorney but i didnt tlike for them to sday i had a prev. injury they going in a different way now, and i dont know what my mmi is goint to be after my fce and rtw.
    so i guess you are right i need to consoult an attorney now i mean now!

    My experience with the doctors that the employer sends you to, are they try to put a bandage on something that they are not experienced with and send you back to work regardless of how much pain you are in. You have the right to choose your own physcian of record, and I encourage you to do this. You need to find a doctor that accepts workers comp claims and specializes in injuries such as yours (neurologist or orthopedics). You then need to submit a c-23 form from the workers comp site fill it out and get yourself an appointment asap with that doctor. I hope by now you have contacted an attorney to help you with your claim and to represent you because until you get one you are going to be at the mercy of your case manager to provide you with there half truths and bull---- answers that ar egoing to make you feel like you have no choices or rights as an injuried worker. Your specilaist will determine what the problem is and when you can return to work. I don't know the laws in your state but I do hope that you will learn them and know your rights as an injuried worker. At this point you have nothing but time on your hand so why not apply it to something that will help you with your claim.

    No, not in every state. Unless of course you'd like to pay out of pocket.
    You then need to submit a c-23 form from the workers comp site fill it out and get yourself an appointment asap with that doctor.
    Not all states use a "c-23 form".
    WC is state specific.

    I agree with you, thats why I say learn the rules that apply to your state. I would almost think that if this is a state that does not allow you to go to a doctor of your choice it would be well worth paying out of pocket to get the proper treatment. I don't know what form your state may use for this but my state uses a c-23 for the change of physician.

    Probably time for the OP to talk to a local workers' comp lawyer and learn his or her rights in own state. There may be something the lawyer could do to help.
