    Default Treated Badly at an IME

    My workers compensation claim was made in the State of: AZ

    I just had my IME today, but it felt more like attorneys questioning me rather then an examination. I had told my family doctor some of my aches and pains I had experienced in the past, like my shoulder hurt me from time to time and my neck hurt sometimes after working on the computer for 8 hours at my job. These aches and pains were mention in December 2011 after I hurt my back lifting 2 cases of water out of my trunk. The IME doctors talked to me like my injuries were all pre existing and had nothing to do with me falling at work on 12/21/2012.

    They made me move my injuried shoulder/arm, neck and back in every directions you can think of. They took a tooth pick and poked me in both arms, legs and back asking me if the pain was the same for both arms, neck and back. I felt like they had already made up their minds before I even went to the appointment. Now my shoulder, arm and back is killing me after they examined me. I don't think the MRI's for my Cervical Spine or right shoulder will make a difference in their minds, even though cervical spine showed cervical ridiculitis and MRI right shoulder showed tearing etc.

    I believe the report will state my pain and lack of motion is due to pre-existing conditions, not from the fall at work. They were rude and seem to not believe a word I was telling them.

    Has anyone else experienced this kind of treatment? They made me feel like I was a criminal and making everythng up!!!!!! Absolutely aweful experience......

    Never had an IME but have had a FCE exam and it was taxing. Do you have a lawyer? When i went for a FCE i was told to cooperate but anything i thought was painful or I didn't feel was safe to decline doing. IC will push and bully if you let them. Being injured doesn't give them carte blanche to do as they please. Quite a few problems can be avoided when you become represented, otherwise you really are guessing or searching the internet for answers to questions. GL

    What is a FCE exam? I do not have an attorney yet. I talked to a family friend that is an attorney for another IC other then the one handling my claim. He told me the doctors I was going to see for my IME are extremely conservative, which is not good. He also told me my IC has bull dog attorneys. He suggested after I receive the IME results and if claim is denied to call him and he would give me a good attorney to contact. He told me the WC community is pretty small and everyone knows who is who.

    you NEED to get an attorney... it is critical and imperative that you do so...otherwise, you are at the mercy and discretion of the IC, and your bests interests will not be served

    IME's don't have to exhibt good bedside manner...there is no patient/Dr relationship here, the IME is a Dr chosen by the carrier as a second opinion and/or to refute your Dr findings.

    I think, even it is prexisted it is ok as long as it count the fell aggrevated it specially you had been working for a year with no problem

    It is always good to take a witness with you whenever you visit a doctor. talk to an attorney.

    FCE Functional Capacity Exam. I would have answered as truthful as possible. If during the exam they began asking questions about previous injuries I would have stopped the exam and asked to see what documents they had. I would have then answered with i don't remember,yes,no. I have found dealing with WC issues it's best to answer yes or no or i don't recall. It is never to your advantage to lie or go on about what you remember. They want to trip you up and have you become combative or just plain give in and say something they can use to there advantage. I been around this forum awhile and by far the biggest universal mistake is not to have an attorney. You need to seek out and interview at least 3 attorneys and choose who you think will be of the greatest help. Listen to your gut and write down questions before you arrive. Choose carefully but don't waste more time, there is a lot of ways to sabotage your case.

    Get a good workers' comp lawyer to help you. Hopefully it is not to late already for you.

    In Ohio You can take a Witness with You to the Exam.
    But by all means,Get a Attorney.You might think it is a waste of Money but in the long run it is worth it.
