    Default Do You Have to Look for Work While Recovering from Surgery

    The Dr. Has me out of work. Im still healing I guess from surgery, and having problems. My work is not returning my calls, or picking up the phone.I cant do my trade, which I only and always have done. Now my lawyer is telling me. I have to look for another job, even though the dr. Has me on tight restrictions. Ive been out 7 months and barely surviving. Anyone know anything about this law? I thought your company had to take you back? Seems like im getting shafted? Help for this one please.

    I'm not sure where you live but many states adopted the right to fire law a few years back & actually they can terminate employment for any reason. It is a law that has hurt a lot of people. We had a similar experience a few years back & the mans recovery took longer than expected & they replaced him. Sorry its not better news. Pray you will find a way out of this mess quickly

    Thanx moe. Would u know. That if the dr. Still has me on restrictions. And I cant do my trade. Does the ins. Co. Still have to pay me? And if I finally get a job I can do. Would there be any type of compensation for the money I lost when I was out of work thanx

    Your lawyer should be explaining all of this to you, you shouldn't be in the dark over anything.
    Yes, you are entitled to wage loss as long as you under restrictions and your employer fails to accommodate those restrictions for any reason.
    If you find another job that pays less, you are entitled to wage differential pay.
