    Unhappy Serious Injury From Falling Through a Ceiling

    My Father, a construction worker that has served the state of Wyoming for fifteen years, installing duct work on almost every building, Is crippled. during a spring afternoon (2003), he was operating within a hazardous area, a completely unlit ceiling space. Ironically this building was the a daycare, and he fell through the weak struts holding the roof up, landing abnormally on his pelvis to where his L-1 disc was completely crushed, and several other disc herniated. Unable to even speak, or move, he was brought to a hospital within an ambulance. Having a plaster mold replacing the broken disc. Unable to fully recover he suffers severe pain every day. When I was just a little boy I had no idea what happened, and I wasn't able to feel worried. But now that I'm sixteen, I've noticed how deprived he is, and how it's effecting me. He's had several failed operations that have done little to help him, some simply making his pain worse. In 2007 a surgery to attempt to bolt his pelvic bone with his spine to reduce the pain and hopefully heal the injury proved ineffective, leaving him in even more pain as the metal in his back deteriorates. I always hear crunches and snaps when he moves, even if he's just walking to the bathroom. It's been eleven full years and a few months since this wound, and it seems his problems only worsen. Not only is his spine damaged, but herniated disc cause extreme pain along the sciatic nerve. Growing old his left articular capsule is torn now, a common injury in aging adults. But due to the several failed injuries, my Father is afraid to even have this checked out. Recently a case was won between my Father and Workman's compensation, granting us enough money to keep our home. However, the money is starting to run out, and for some reason my Father's benefits have been revoked. I'm unsure how many people have had things like this happen to them... But it's just not right. My Father is now attempting to prove that he is crippled to get his benefits back. How would you feel if you could not walk, and you had benefits to keep your family with you, but suddenly these benefits were revoked. And you have to prove you can't stand, and provide for your family. Of course you can't. But the Doctors say otherwise. It's purely insulting. For me as a child, I've only recently noticed that the stress this causes is starting to now pile on me. My father never got to enjoy having a son for a good portion of his life because of his injury. I never got to play football with my father. I've been able to learn things he's wanted to teach me because his pain prevents him from even standing with me for an extended amount of time. And now it seems like everyone is against us. It's just not right.

    Just thinking about this makes me tear up.

    I am really sorry about your situation. I hope your dad has a very good workers' compensation lawyer. Workers' comp would have been his only remedy and it is complicated. He needs a good lawyer to accomplish what he is trying to do in the workers' comp system.

    He may also want to apply for Social Security Disability, but he should discuss that with his lawyer first. I wish you and your family the best.
