    Default Why is a Settlement Offer Less than the Total Payments Would Be

    After 5 yrs. in WC system I recieved my rating & settlement offer. The rating is 35% for 4 body parts & CRPS.
    I suffered through 2 surgeries, various pt's & all the shots. I refused the last 2 surgeries. One 4 multi level fusion on neck and 1 for severely torn labrum.
    I have lost everything !
    The offer is less than 20 grand. Plus annual pymt's of $800. I had taken a min. wage job because Commercial Real Estate was dead.

    If I take mo. pymt.'s it doubles the settlement and & then some. This is a hard 1 to call.. I deserve the full amount. Why am I penalized?
    Also the VR counselor said that because my qualifications far exceed that of " dish washer" my ER should b able 2 place me somewhere, as it's a casino. Yet, in 5 years nothing.
    The other strange thing, Sat. I recieved a call from an independent contractor 4 SSA. Stating that they place people on disability w/home based jobs.
    The only person I have mentioned anything too was the PT who administered the fce. exam & admitted 2 being a friend of my adjuster. She also stated my adjuster sends her business.
    So if I refuse this offer, which comes 14 mo.'s after federal disability was approved, I can terminate my voc rehab benefits
    That's my understanding.
    Any guidance will b greatly appreciated. I have an attorney I do not trust. He has been with 3 firms in 5 yrs. He now has 2 split my commission 3 ways, not much $ in his pocket. This is just 1 of many issues I have with him.
    I hope I have been clear, so I can get an unbiased opinion.

    I disabled that link, it's considered spam.
    Don't do anything without you lawyer's knowledge and approval.
    Taking some low wage at home telemarketing job will probably cost you the farm, you could lose your SSDI.

    Do u mean, the web site I mentioned is considered spam even if I'm not affiliationed or trying 2 sell something.

    Anytime you post a link to a site that's selling, soliciting or data mining - it's spam, that site is poison in an environment such as this.
    There's no need to post a direct link to that site, I think I'll go a step further and remove the link in it's entirety - no one will know the difference.

    I added the link because I was hoping 4 feedback & because I thought SSA or my adjuster had instructed them 2 contact me... Otherwise, how did they get my contact info.
    Until yesterday I had never heard the term, "data mining ". Learned something new. Thx.
    I trying 2 find interaction w/other IW's who r @ the end of this process & can discuss questions I have Re: settlement any. FCE exam results & returning 2 work but there isn't much activity here.
    Is there another area I can post in ?

    The truth is I just want 2 talk someone who understands.

    If you had a referral from your adjuster or SSA, they would notify you of such and tell you what to expect.
    I think they are spammers, never respond to unsolicited contacts, you could jeopardize your case - never do anything without consulting your attorney.

    This is a good place to kick the can and share experiences.

    People probably won't share much in terms of settlements or details about their case, they could be identified by doing so.
    This place has been slow lately, that's a good thing - it means few people have problems.
    It goes in waves, it can pick up at anytime.
