Question Denied Workman Comp Based on Claim That Injury Isn't Work-Related

May 12, 2014 was hurt at work. displaced two ribs and couldn't even breath, but workman comp is denied it saying because I saw a Dr for problems in the same area it is not work related. My atty says it will be hard to prove. Now I have been told I also have carpal tunnel in my left hard. I do heavy over the head lifting 200 to 600 times a day. I'm still have problems with ribs, back of shoulder and right arm. Drs are still trying to find out what is wrong.

My work as told the adjuster with the insurance company that they have offer me work and now they are telling unemployment that I can't work. Il has now denied my unemployment. I don't have a job because with the restriction the dr put me on I couldn't return to the heavy lifting, but can do other work. I think my atty. has drop the ball. I'm trying to fight workman comp and Il unemployment. Any ideas that might help

Workman comp has not paid any benefits or medical and my lawyer can't seem to get anything done

    What state?
Focus on your comp claim, sounds like you need a real attorney.

A lawyer who isn't willing to go to court and fight for you won't get anything done.
The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).

Il, and he doesn't think it is a big deal that they are telling different stories. He also says it will be hard to prove my carpal tunnel is from work. Really! 2 and 1/2 years lifting 20 to 50 lb 200 to 600 times a day. I was always unloading the trucks Suppose to meet him tomorrow

    Kneebow here,

I don't think you have anything to worry about with your work history and an attorney that specializes in workers comp.

    Good blessings too ya!

Make sure you have a trial attorney, usually they fear nothing and will fight for you regardless of how long and how hard it is.
