    Default Settling a Permanent Partial Disability Claim

    My workers compensation claim was made in the State of: Kentucky I have reached mmi with a 15% permanent disability it is my right knee acl reconstruction I am 47 yrs. old I am a utility lineman its all I have done since I was 17 yrs. old I cannot go back to this can no longer climb poles knee very weak I have a lawyer but the settlement still in the air anyone have any ideal what its worth Thanks

    From what I see, you would be eligible for 425 weeks of payments at the rates explained in the below charts if this injury occurred after July13 2013.
    This is just an estimate, only your lawyer can give an exact figure based on the facts of your case.

    The number of payments depends on the disability rating. With a permanent disability rating of 50% or less,
    benefit payments will extend to 425 weeks; while a permanent disability rating greater than 50% will be paid
    for 520 weeks. The amount of benefit payments also depends on the impairment rating, which is then
    multiplied by a factor. This factor is established by law and subject to change. The impairment rating multiplied
    by the factor establishes the “permanent disability rating.”

    AMA Impairment Rating = Factor
    0-5% = 0.65
    6-10% = 0.85
    11-20% = 1.00
    21-25% = 1.15
    26-30% = 1.35
    31-35% = 1.50
    36% and above = 1.70

    With an AMA functional impairment rating of 15% and an average weekly
    wage of $350, this injured worker will receive $35.00 in weekly permanent
    partial disability benefit payments.
    $350 x 66.67% = 233.33
    $233.33 x 15% (AMA impairment rating) = $35.00
    $35.00 x 1.00(Factor) = $35.00 per week (base benefit)

    If this worker does not retain the physical capacity to return to the type of work performed at the time of
    injury, the weekly disability payment is multiplied by 3 and will be:
    $35.00 x 3 = $105.00

    Default Kentucky Knee Injury

    Hello... I have reached mmi my rating as of now is 15%.... how does age and work figure in this... also I am a utility lineman been climbing poles since I was 18 now I am 47 but doc. says the climbing is over it is all I have ever done... there is future surgeries aThank you
