    Question TTD Benefits Stopped with No Warning

    I need some help. I was injured at work in April of 2015. I have a "T.V. Attorney", but have only actually talked to him twice since my injury. The rest of the time, it is either voicemail or a paralegal, (if I am lucky). I was receiving TTD benefits and was still treating. I was okayed for a prosthetic device while all my stuff was going on. Then the last thing I was waiting on was to see a surgeon......the okayed 1 surgeon for me to see, but I myself and a lady from the Orthopedic office tried scheduling the appointment, and the surgeons office said it had to be made by the insurance company only and that when they scheduled the appointment, they had to notify me. I have been waiting MONTHS, and nothing. I kept calling the surgeons office to see if they had made the appointment only to find out I was and am still not in their computer system. Gallagher and Bassett totally STOPPED my TTD payments with no notice at all. I even had the paralegal go thru my file just incase they received something, but she said they had not received nothing. She then stated to me that if I wanted some form of pay, that I was to go find a part-time job. I wear a prosthetic device, I have an open insurance claim, and I have permanent restrictions till all of this ends. My attorney's office does not seem to be worried about me and my family and I am receiving absolutely nothing. It is bad enough that when I was originally injured it took them 12 LONG weeks to send me my first payment (which by then my vechicle was repossessed), then when I got the back pay for 12 weeks, I got another car to make it to appointments, which was then repossessed again when my payments stopped. Like I said, they NEVER gave me notice of starting benefits or stopping them, I can't talk to my attorney himself and his paralegals know nothing but tell me to go find a part-time job. Can they do this? I REALLY need some advice. PLEASE HELP! Thank you in advance. Cause rite now, I am wanting to go sit in my attorneys office until I talk to him and find out whats going on. By the way, I have NEVER received one lick of paperwork for anything from Gallagher and Bassett or my Attorney. Is this the correct protocol? Again, somebody please help me. My family is STARVING

    You need to be represented by an attorney who provides the legal services that you need. Unfortunately, your situation illustrates what can happen when folks don't choose their attorney carefully enough. You always have the right to fire a sorry lawyer and hire a better one.

    Here in NC, there are ways to get the TTD started again when the carrier stops it for wrong reasons. But it requires a lawyer who gives a crap and who also knows what to do, and is focused on actually helping his clients rather than simply getting quick settlements in order to pay the massive advertising expenses. Hopefully there is a way to get your TTD restarted there in your state too.

    UPDATE: I received a letter today stating I finally have an appointment with the surgeon on the 21st and I have to have an IME evaluation this coming Monday. But still no benefits reinstated

    UPDATE: So, I went to the IME appointment this morning......The appointment had been scheduled for over two weeks, and when I got there, The Dr. only had 1 paper TOTAL in the file and it was from the first work dr. I saw after leaving the Hospital, which this dr. tried saying my wrist was in fact not broke and I needed to return to work! I Had then saw the actual orthopedist which in turn casted my arm and wrist on my first visit! I am STILL unable to get in touch with my Attorney himself, (I have not spoke to him, himself since July of last year 2015, and I have left him countless e-mails and no matter how important, he never returns a call). Anyway, workers comp now owes me over $4,000 for they had stopped my benefits at the end of November for supposidly missing a dr. appointment (which we have already proved was never scheduled), and I don't think my attorney is even trying to get my benefits reinstated. I talked to the workers comp commission and they were never notified either of my payments being stopped. Any input on this would be greatly appreciated. By the way, I ended up leaving the IME appointment MRi and EMG, so he could complete the assessment. Then I thought I was seeing a surgeon to possibly try to fix my problem, only to be told by this dr. that it will be the same thing I did today only he was hired by my attorney and the one I see on the 21 was scheduled by opposing councils attorneys. He also added he bets THAT dr. will have ALL the paperwork he needs. Help on this issue?
