    Default Should Your Lawyer be Able to Estimate a Workers Comp Settlement

    I have been on workers comp for a year now . All test are done , I got 23% whole body disability in my lower extremity . I had a private mediation set up and it keeps getting moved back. For some reason the woman who is doing it decided she wants vacation that week after a month of it being scheduled , and I guess the only person that does this in the state of Georgia . I've asked my attorney what is bottom line real money are we talking about and she can't and won't answer that . She keeps blowing smoke talking different crap. Everything I have read up on from other attorneys , said your lawyer should know a ballpark figure . I have never had to do any of this or know anyone that has . My employer has been paying me 40 hours a week and never reduced my pay to workers comp pay . Everything is just getting really sketchy and I don't believe in my attorney anymore . They talk a big game but they don't know anything . She talks to me like she works for my employer

    my lawyer wouldn't say a dollar amount because, he told me if its lower, youll be pissed and say I didn't do a good job. go to your states w/c page they have a listing of dollar ammouints that should be paid out for specific injuries. most cases those are max $ ammonts

    You are wanting your lawyer to predict how much the insurance company may be willing to pay. That is quite difficult to predict in most cases. The insurance company is not necessarily evaluating your case for settlement in the same way that you and your lawyer might evaluate it, and there is no way to know how they are evaluating it until they want to tell you--at the mediation.
    The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).

    No not wanting her to predict a amount , but would like for her to discuss with me how low is not worth taken . I know she don't care because she gets paid anyways , but if I bring in over 500 a week now and got over 300 weeks left on workers comp . What's the game plan ? I'm in the dark about everything . I don't get told what's going on til I call her , any changes I find out then . It's like I'm the one doing my own thing . She put in for the max but said we won't get that . Well of course , but what is the real guess. If she can tell me we are not getting that then she would be able to tell me something . She has worked with all these people before , which I'm not crazy about .

    make a face to face meeting with the lawyer bring a list of questions with you to ask him. don't take NO for an answer
