    Default What to Do About My Boss Who is a Control Freak

    I work for a real estate company. We had a meeting with just my boss and 5 maintenance guys, all the office workers and the owner of the company were not there. At the meeting 1 guy asked for the day off because of a sore back. My boss said"you can take as much time off as you like but the next guy to file a worker's comp claim will be fired."
    Well about 3 months later I did hurt my back. I didn't tell anyone for 3 months. The pain got to bad that I had to go to the doctor's, MRI showed 3 broken vertebrae and 2 ruptured discs. I needed emergency spinal fusion surgery and disc replacement with a bone graft. My boss said that I will go out on unemployment and they will keep all my benefits going until recovery is complete. After surgery everything changed ,my benefits were dropped in the middle of pt . Unemployment told me what I was trying to do was illegal. My last pay check was the week of my surgery. I called the owner and emailed him and wrote him afew text, he sent me back to my boss. He clearly didn't know what was going on and didn't want anything to do with it. Well all the maintenance guys that I Work with for 15 years suddenly didn't remember that meeting ,in fear of losing their jobs. I received a phone call telling me to stop harassing the staff.
    Now we're in a 2 year dispute over comp liability. I lost everything and still haven't received a penny from workers comp insurance.

    I'll be brief, you did everything 100% wrong - this is a text book case on how to destroy a claim.
    Based on the info you posted in other threads I think it will be next to impossible to win your claim.
    All you can do at this point is let your lawyer do his job and pray - you have a fine mess on your hands.

    Yes you are absolutely right, I do have a mess on my hands. Hearing date is first week in September.

    If you had three fx vertebra and two HNPs, then you must have had one heck of an accident. Wasn't such a big accident documented in a way that you can show it was work-related?

    I worked alone.I didn't know that my injury was so severe. I didn't go to the emergency room or my see my pc until the pain was unbearable. My neurosurgeon told me that he couldn't believe how I'm standing in his office , he said people with my MRI reading can't walk. I told him I was working full-time,he said not anymore your not. I was in for surgery as soon as there was an available operating room.
    The doctor told me 5-6 months recovery time.
    After the surgery he told me my back was worse than originally thought and I would not be able to return to the work I was doing. The recovery time went to 12-18 months. It was at this point that I realized that I made the mistake of worring about my job instead of my health. Big Mistake. Please don't anyone else ever listen to promises made by their employers.

    I had my hearing scheduled for the first week of September. After waiting for months my lawyer called me 3 days before the hearing and said it's been cancelled. He said that there's new medical to be reviewed. Of course there is, I'm still being treated and will be for years to come. They don't care about how long this process takes became it doesn't affect them on a personal or financial level.
