My company is self funded worker compensation. They offered and I purchased a supplemental LTD coverage. I was injured on the job and received a benefit of 66 2/3%. After 90 days I applied for and was approved for the LTD which covered 33 1/3% of my pre-injury wages. The company stopped paying my workers compensation benefit. My benefits have been reinstated but the company claims I am not entitled to receive my comp benefits or even the difference because I waould be getting paid twice. It appears that my LTD is limited by my comp benefits and I would not be entitled to benefits in excess of my pre-injury wages which did not occurred. I do not see where my comp benefits are limited by receipt of private LTD other than the legal limit that all benefits can not be in excess of my full lost wages.
