    Default Blood Clots and Pe's

So, just wanted to start off by saying hello and thanking you guys for continuing to moderate and keep this website rolling. For people who are trying to navigate through the murky waters of workmans comp, this info is priceless. Let me share my story and maybe get some advice while I'm here? Thank you.

My name is Justin and I'm 31 years old. Let me mention that I am very grateful that we live in a country where we even HAVE workers compensation. Even though it doesn't go as planned, and it isn't perfect, at least it's there!

    Onward I go.
So in Jan I slipped and fell on the job. I was delivering a load of fuel to andrilling rig and it was iced over. I completely severed my patellar tendon (pain...omg the pain...). I was rushed to the hospital and we went through all the paperwork and procedure...blah blah blah. Work comp accepted my case. My dispatcher lied and told work comp that I was told not to go out but I've got proof to the contrary. So I went into surgery like 6 days after my injury and had the tendon reattached. The surgeon sent me home that day and told me to stay immobile for two days. He didn't send me home with any anticoagulants...and surprise surprise...I developed a DVT which led to a pulmonary embolism (PE). 4 days in the hospital, 8 shots and many pills later, in released. Doctor puts me on blood thinners and said I'll only need them for 6 months. Work comp gets me a primary care physician and pays for blood thinners (also, they've paid me TTD benefits every week from week one). Three mlnths go by, I'm still having random fits of breathlessness and occasionally I wake from a dead sleep trying to catch my breath. The work come doc says it's anxiety. Well, it wasn't. Mid April I have what felt like a heart attack. I'm rushed to the hospital where they find numerous blood clots in my lungs (PE's) and another DVT in my arm (they actually think that ones been there since January). So I spend 5 more days in the hospital and the work comp primary eventually takes me off Xarelto. I've just started therapy a month ago.

So, I cannot renew my CDL as long as I have an active blood clot. I have to have 3 months free of PE's before I can renew, also. I can't go back to my old job without a CDL. Also, they're talking about leaving me on blood thinners for the rest of my life even though I tested negative for a clotting disorder. I'm looking at major life altering issues here and am wondering if I should get an attorney...

Suggestions? Input? I have not been offered anything and I haven't asked. I've qualified for maximum weekly TTD benefits (which is about $400 less a week than I was netting) and they've been paying any and all medical expenses.

PS: I had to go get stronger blood pressure meds cuz the ortho refused to give me pain medicine. We tried PT for 3 sessions at home and the pain was so intense it was sending my blood psi into ER levels...crazy

Work comp lawyers give free initial consultations. Pick out the best ones in your area and go get some free consultations. It is ok to ask them whether you need a lawyer or not. The best lawyers will give you an honest answer and explain why.
The North Carolina Court of Appeals has held that "In contested Workers' Compensation cases today, access to competent legal counsel is a virtual necessity." Church v. Baxter Travenol Labs, Inc., and American Motorists Insurance Company, 104 N.C. App. 411, 416 (1991).
