    Default Settlement and MSA

    My lawyer just called today & let me know that employer lawyer want to allocate 25k towards MSA & 50K as settlement amount. They are doing a structured MSA allocation ( not sure if I worded it right ). Do I have to itemize every expense when I account for this money to Medicare ?

    You need to be discussing this with your lawyer. That is who is getting paid to give you legal advice.

    You should received some paperwork as part of the settlement documents that details the MSA and what must be done. But what likely you will need to do is document what is paid out for medical bills that would otherwise have been paid by the WC claim. So you would not need to itemize expenses that are completely unrelated. But again, definitely go over this with your attorney.
